بَابُ مَنْ أَعْتَقَ عَبْدًا أَوْ شَرَطَ عَلَيْهِ خِدمَتَهُ وَحُكْم مَنْ مَلِكَ ذَا رَحِمٍ مُحَرَّمٍ أَوْ أَعْتَقَ مَالَمْ يَمْلِك
Chapter on Whoever Frees a Slave or Conditions His Service, and the Ruling of One Who Owns a Forbidden Relative or Frees What He Does Not Own

Hadith 5261
Under this chapter, the following sub-chapters and hadiths have been mentioned.
عَنْ سَفِينَةَ أَبِي عَبْدِ الرَّحْمَنِ رَضِيَ اللَّهُ عَنْهُ قَالَ أَعْتَقَتْنِي أُمُّ سَلَمَةَ رَضِيَ اللَّهُ عَنْهَا وَاشْتَرَطَتْ عَلَيَّ أَنْ أَخْدَمَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَا عَاشَ
It is narrated from Sayyiduna Abu Abdur Rahman Safeena, he says: Sayyida Umm Salama (may Allah be pleased with her) set me free, but she stipulated the condition that I would serve the Noble Prophet (peace and blessings be upon him) as long as he (peace and blessings be upon him) remained alive.
Hadith 5262
عَنْهُ بِالسَّنَدِ الْأَوَّلِ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ مَنْ مَلَكَ ذَا رَحِمٍ مُحَرَّمٍ فَهُوَ عَتِيقٌ
With the first chain of narration, it is also narrated from Sayyiduna Samurah (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: Whoever becomes the owner of a close blood relative, then such a slave will become free.
عَنْ سَمُرَةَ بْنِ جُنْدُبٍ رَضِيَ اللَّهُ عَنْهُ رَفَعَهُ قَالَ مَنْ مَلَكَ ذَا رَحِمٍ فَهُوَ حُرٌّ
Narrated by Sayyiduna Samurah bin Jundub (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: Whoever becomes the owner of a mahram relative, that person will become free.
Hadith 5262
عَنْ سَمُرَةَ بْنِ جُنْدُبٍ رَضِيَ اللَّهُ عَنْهُ رَفَعَهُ قَالَ مَنْ مَلَكَ ذَا رَحِمٍ فَهُوَ حُرٌّ
Narrated by Sayyiduna Samurah bin Jundub (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: Whoever becomes the owner of a mahram relative, that person will become free.

Hadith 5263
عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَا يَجْزِي وَلَدٌ وَالِدَهُ إِلَّا أَنْ يَجِدَهُ مَمْلُوكًا فَيَشْتَرِيَهُ فَيُعْتِقَهُ
It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: No child can repay his father or mother, except that he finds them as a slave and buys them and sets them free.
Hadith 5264
عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ لَيْسَ عَلَى رَجُلٍ طَلَاقٌ فِيمَا لَا يَمْلِكُ وَلَا عِتَاقَ فِيمَا لَا يَمْلِكُ وَلَا بَيْعَ فِيمَا لَا يَمْلِكُ
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: There is no divorce for a man in that which he does not own, there is no emancipation in that which he does not own, and there is no transaction in that which is not in his possession.
