Hadith 5085
عَنْ عَمِّهِ قَالَ وَزَعَمَ عُرْوَةُ بْنُ الزُّبَيْرِ أَنَّ مَرْوَانَ وَالْمِسْوَرَ بْنَ مَخْرَمَةَ أَخْبَرَاهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَامَ حِينَ جَاءَهُ وَفْدُ هَوَازِنَ مُسْلِمِينَ فَسَأَلُوا أَنْ يَرُدَّ إِلَيْهِمْ أَمْوَالَهُمْ وَسَبْيَهُمْ فَقَالَ لَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَعِي مَنْ تَرَوْنَ وَأَحَبُّ الْحَدِيثِ إِلَيَّ أَصْدَقُهُ فَاخْتَارُوا إِحْدَى الطَّائِفَتَيْنِ إِمَّا السَّبْيَ وَإِمَّا الْمَالَ وَقَدْ كُنْتُ اسْتَأْنَيْتُ بِكُمْ وَكَانَ أَنْظَرَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِضْعَ عَشْرَةَ لَيْلَةً حِينَ قَفَلَ مِنَ الطَّائِفِ فَلَمَّا تَبَيَّنَ لَهُمْ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ غَيْرُ رَادٍّ إِلَيْهِمْ إِلَّا إِحْدَى الطَّائِفَتَيْنِ قَالُوا فَإِنَّا نَخْتَارُ سَبْيَنَا فَقَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِي الْمُسْلِمِينَ فَأَثْنَى عَلَى اللَّهِ عَزَّ وَجَلَّ بِمَا هُوَ أَهْلُهُ ثُمَّ قَالَ أَمَّا بَعْدُ فَإِنَّ إِخْوَانَكُمْ قَدْ جَاءُوا تَائِبِينَ وَإِنِّي قَدْ رَأَيْتُ أَنْ أَرُدَّ إِلَيْهِمْ سَبْيَهُمْ فَمَنْ أَحَبَّ مِنْكُمْ أَنْ يُطَيِّبَ ذَلِكَ فَلْيَفْعَلْ وَمَنْ أَحَبَّ مِنْكُمْ أَنْ يَكُونَ عَلَى حَظِّهِ حَتَّى نُعْطِيَهُ إِيَّاهُ مِنْ أَوَّلِ مَا يُفِيءُ اللَّهُ عَزَّ وَجَلَّ عَلَيْنَا فَلْيَفْعَلْ فَقَالَ النَّاسُ قَدْ طَيَّبْنَا |ا ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ لَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِنَّا لَا نَدْرِي مَنْ أَذِنَ مِنْكُمْ فِي ذَلِكَ مِمَّنْ لَمْ يَأْذَنْ فَارْجِعُوا حَتَّى يَرْفَعَ إِلَيْنَا عُرَفَاؤُكُمْ أَمْرَكُمْ فَجَمَعَ النَّاسُ فَكَلَّمَهُمْ عُرَفَاؤُهُمْ ثُمَّ رَجَعُوا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَأَخْبَرُوهُ أَنَّهُمْ قَدْ طَيَّبُوا وَأَذِنُوا هَذَا الَّذِي بَلَغَنِي عَنْ سَبْيِ هَوَازِنَ
Urwah bin Zubair narrates that Marwan and Sayyiduna Miswar bin Makhramah (may Allah be pleased with him) told him that when the delegation of Hawazin came submissively to the Messenger of Allah (peace and blessings be upon him) and asked him to return their wealth and captives, the Messenger of Allah (peace and blessings be upon him) said to them: "You see the people who are with me (this booty is their right), and the most beloved thing to me is the truth, so choose one of the two things: either take the captives or the wealth. It was only because of you that I delayed the distribution." The Messenger of Allah (peace and blessings be upon him) had waited for them for fifteen or sixteen days after returning from Ta’if. When it became clear to them that the Messenger of Allah (peace and blessings be upon him) would give them only one thing, they said: "Yes, we will give preference to our captives." The Messenger of Allah (peace and blessings be upon him) stood among the Muslims, praised Allah as He deserves to be praised, and then said: "Amma ba’du! These brothers of yours have come to you repentant, and I have deemed it appropriate to return their captives to them. Whoever wishes to do so willingly, let him accept my decision, and whoever wants to take his share, we will give him from the wealth that Allah will grant us first. Such a person should also express his decision." The people said: "We have happily accepted this decision for the sake of the Messenger of Allah (peace and blessings be upon him)." But the Messenger of Allah (peace and blessings be upon him) said: "We do not know who among you is giving permission and who is not, so go back and let your chiefs inform us about your consent." So they gathered the people, and each chief spoke to his tribe, and then they informed the Messenger of Allah (peace and blessings be upon him) that the people were indeed happily accepting his decision and giving permission. This is what I have come to know regarding the captives of Hawazin.
Hadith 5086
عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا قَالَ أَعْطَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ جَارِيَةً مِنْ سَبْيِ هَوَازِنَ فَوَهَبَهَا لِي فَبَعَثْتُ بِهَا إِلَى أَخْوَالِي مِنْ بَنِي جُمَحٍ لِيُصْلِحُوا لِي مِنْهَا حَتَّى أَطُوفَ بِالْبَيْتِ ثُمَّ آتِيَهُمْ وَأَنَا أُرِيدُ أَنْ أُصِيبَهَا إِذَا رَجَعْتُ إِلَيْهَا قَالَ فَخَرَجْتُ مِنَ الْمَسْجِدِ حِينَ فَرَغْتُ فَإِذَا النَّاسُ يَشْتَدُّونَ فَقُلْتُ مَا شَأْنُكُمْ قَالُوا رَدَّ عَلَيْنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَبْنَاءَنَا وَنِسَاءَنَا قَالَ قُلْتُ تِلْكَ صَاحِبَتُكُمْ فِي بَنِي جُمَحٍ فَاذْهَبُوا فَخُذُوهَا فَذَهَبُوا فَأَخَذُوهَا
It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) gave Sayyiduna Umar bin Khattab (may Allah be pleased with him) a slave woman from among the captives of Hawazin, and he gave her to me. I sent her to my maternal uncles from Banu Jumah so that they could prepare her, and I could perform Tawaf, then I would go to them, intending to have intercourse with her when I returned. But when I finished and came out of the mosque and saw the people of Hawazin running, I said: What has happened to you people? They said: The Messenger of Allah (peace and blessings be upon him) has returned our sons and women to us. I said: Then one of your women is with the tribe of Banu Jumah, go and take her as well. So they went and took that woman with them.
