باب النهي عَنِ الْمُثْلَةِ وَالتَّحْرِيقِ وَقَطْعِ الشَّجَرِ وَهَدْمِ الْعَمَرَانِ إِلَّا لِحَاجَةٍ وَمَصْلِحَةِ
Chapter on the Prohibition of Mutilation, Burning, Cutting Trees, and Destroying Buildings Except for Need and Benefit
Hadith 5001
عَنْ ثَوْبَانَ مَوْلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنَّهُ سَمِعَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ مَنْ قَتَلَ صَغِيرًا أَوْ كَبِيرًا أَوْ أَحْرَقَ نَخْلًا أَوْ قَطَعَ شَجَرَةً مُثْمِرَةً أَوْ ذَبَحَ شَاةً لِإِهَابِهَا لَمْ يَرْجِعْ كَفَافًا
Mawla of the Messenger, Sayyiduna Thawban (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: Whoever kills a small child or an old man, or burns date-palm trees, or cuts down a fruit-bearing tree, or slaughters a goat for its skin, then he will not return from this jihad with any reward at all.
Hadith 5002
عَنْ عِمْرَانَ بْنِ حُصَيْنٍ رَضِيَ اللَّهُ عَنْهُ قَالَ مَا قَامَ فِينَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ خَطِيبًا إِلَّا أَمَرَنَا بِالصَّدَقَةِ وَنَهَانَا عَنِ الْمُثْلَةِ قَالَ قَالَ أَلَا وَإِنَّ الْمُثْلَةَ أَنْ يَنْذُرَ الرَّجُلُ أَنْ يَخْرُمَ أَنْفَهُ
It is narrated from Sayyiduna Imran bin Husain (may Allah be pleased with him), he says: Whenever the Messenger of Allah (peace and blessings be upon him) stood to address us, he would command us to give charity and forbid mutilation, and he would say: Beware! This too is mutilation, that a person vows to pierce his nose or to tear it.
Hadith 5003
عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَنِ الْمُثْلَةِ
It is narrated from Sayyiduna Mughirah bin Shu’bah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) forbade mutilation.
Hadith 5004
عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَطَعَ نَخْلَ بَنِي النَّضِيرِ وَحَرَّقَ
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him and his family) had the date palm trees of Banu Nadir cut down and also burned.
Hadith 5005
عَنْ أُسَامَةَ بْنِ زَيْدٍ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ كَانَ وَجَّهَهُ وَجْهَةً فَقُبِضَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَسَأَلَهُ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ مَا الَّذِي عَهِدَ إِلَيْكَ قَالَ عَهِدَ إِلَيَّ أَنْ أُغِيرَ عَلَى أَبْنَاءِ صَبَاحًا ثُمَّ أُحَرِّقَ
It is narrated from Sayyiduna Usama bin Zaid (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) had sent him to a certain place, but then the Prophet (peace and blessings be upon him) passed away. Then Sayyiduna Abu Bakr (may Allah be pleased with him) asked him: What advice did the Messenger of Allah (peace and blessings be upon him) give you? He said: The Prophet (peace and blessings be upon him) advised me to attack the Abna village in the morning and then burn it.
Hadith 5006
(وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) قَالَ بَعَثَنِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِلَى قَرْيَةٍ يُقَالُ لَهَا أَبْنَاءُ فَقَالَ ائْتِهَا صَبَاحًا ثُمَّ حَرِّقْ
(Second chain) Sayyiduna Usama (may Allah be pleased with him) says: The Messenger of Allah (peace and blessings be upon him and his family) sent me to a village named Abna and said: Go there in the morning and burn it.
Hadith 5007
عَنْ جَرِيرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَلَا تُرِيحُنِي مِنْ ذِي الْخَلَصَةِ وَكَانَ بَيْتًا فِي خَثْعَمَ يُسَمَّى كَعْبَةَ الْيَمَانِيَّةَ فَنَفَرْتُ إِلَيْهِ فِي سَبْعِينَ وَمِائَةِ فَارِسٍ مِنْ أَحْمَسَ قَالَ فَأَتَاهَا فَحَرَّقَهَا بِالنَّارِ وَبَعَثَ جَرِيرٌ بَشِيرًا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا أَتَيْتُكَ حَتَّى تَرَكْتُهَا كَأَنَّهَا جَمَلٌ أَجْرَبُ فَبَرَّكَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَلَى خَيْلِ أَحْمَسَ وَرِجَالِهَا خَمْسَ مَرَّاتٍ
Narrated from Sayyiduna Jarir bin Abdullah (may Allah be pleased with him), he says: The Messenger of Allah (peace and blessings be upon him) said to me: Will you not relieve me from Dhu al-Khalasah? It was a house of the Khath'am tribe, which was called the Ka'bah of Yemen. I went towards it with one hundred and seventy horsemen from the Ahmas tribe. They went there and set it on fire, burning it down. Then Sayyiduna Jarir (may Allah be pleased with him) sent a bearer of good news to the Messenger of Allah (peace and blessings be upon him), and he came and said: By the One Who has sent you with the truth! I have come to give you glad tidings, leaving that house like a mangy camel. So the Messenger of Allah (peace and blessings be upon him) prayed for blessings five times for the horsemen and foot soldiers of the Ahmas tribe.
Hadith 5008
عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ بَعَثَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِي بَعْثٍ فَقَالَ إِنْ وَجَدْتُمْ فُلَانًا وَفُلَانًا لِرَجُلَيْنِ مِنْ قُرَيْشٍ فَأَحْرِقُوهُمَا بِالنَّارِ ثُمَّ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ حِينَ أَرَدْنَا الْخُرُوجَ إِنِّي كُنْتُ أَمَرْتُكُمْ أَنْ تُحْرِقُوا فُلَانًا وَفُلَانًا بِالنَّارِ وَإِنَّ النَّارَ لَا يُعَذِّبُ بِهَا إِلَّا اللَّهُ عَزَّ وَجَلَّ فَإِنْ وَجَدْتُمُوهُمَا فَاقْتُلُوهُمَا
It is narrated from Sayyiduna Abu Hurairah, may Allah be pleased with him, who says: The Messenger of Allah, peace and blessings be upon him, sent us in an expedition and said: If you find such and such two men of the Quraysh, then burn them with fire. Then when we intended to depart, he, peace and blessings be upon him, said: I had ordered you to burn such and such men with fire, but the only one who punishes with fire is Allah Almighty, so if you find them, then kill them.
Hadith 5009
عَنْ حَمْزَةَ بْنِ عَمْرٍو الْأَسْلَمِيِّ صَاحِبِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ رَضِيَ اللَّهُ عَنْهُ حَدَّثَهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بَعَثَهُ وَرَهْطًا مَعَهُ إِلَى رَجُلٍ مِنْ عُذْرَةَ فَقَالَ إِنْ قَدَرْتُمْ عَلَى فُلَانٍ فَأَحْرِقُوهُ بِالنَّارِ فَانْطَلَقُوا حَتَّى إِذَا تَوَارَوْا مِنْهُ نَادَاهُمْ أَوْ أَرْسَلَ فِي أَثَرِهِمْ فَرَدُّوهُمْ ثُمَّ قَالَ إِنْ أَنْتُمْ قَدَرْتُمْ عَلَيْهِ فَاقْتُلُوهُ وَلَا تُحْرِقُوهُ بِالنَّارِ فَإِنَّمَا يُعَذِّبُ بِالنَّارِ رَبُّ النَّارِ
It is narrated from the Companion of the Messenger, Sayyiduna Hamza bin Amr Aslami (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) sent him along with an army to a man from the tribe of ‘Uzrah and said: If you overpower so-and-so, then burn him with fire. So he set out, and when he was about to be out of sight of the Prophet (peace and blessings be upon him), the Prophet (peace and blessings be upon him) called him back by sending someone after him, and then said: If you overpower that man, then kill him, do not burn him with fire, for only the Lord of the Fire punishes with fire.
