بَابُ حُكْمِ مَنْ حَاضَتْ بَعْدَ طَوَافِ الْإِفَاضَةِ
Chapter on the Ruling of a Woman Who Menstruates After Tawaf al-Ifadah
Hadith 4588
عَنْ قَتَادَةَ عَنْ عِكْرِمَةَ قَالَ: إِنَّ زَيْدَ بْنَ ثَابِتٍ وَابْنَ عَبَّاسٍ اخْتَلَفَا فِي الْمَرْأَةِ تَحِيضُ بَعْدَ الزِّيَارَةِ فِي يَوْمِ النَّحْرِ بَعْدَمَا طَافَتْ بِالْبَيْتِ فَقَالَ زَيْدٌ: يَكُونُ آخِرَ عَهْدِهَا الطَّوَافُ بِالْبَيْتِ وَقَالَ ابْنُ عَبَّاسٍ: إِذَا طَافَتْ يَوْمَ النَّحْرِ تَنْفِرُ إِنْ شَاءَتْ فَقَالَ الْأَنْصَارُ: لَا نُتَابِعُكَ يَا ابْنَ عَبَّاسٍ وَأَنْتَ تُخَالِفُ زَيْدًا فَقَالَ: وَاسْأَلُوا صَاحِبَتَكُمْ (أُمَّ سُلَيْمٍ) فَقَالَتْ: حِضْتُ بَعْدَمَا طُفْتُ بِالْبَيْتِ يَوْمَ النَّحْرِ فَأَمَرَنِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنْ أَنْفِرْ وَحَاضَتْ صَفِيَّةُ فَقَالَتْ لَهَا عَائِشَةُ: الْخَيْبَةُ لَكِ إِنَّكِ لَحَابِسَتُنَا فَذُكِرَ ذَلِكَ لِلْنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ: ((مُرُوهَا فَلْتَنْفِرْ))
Ikrimah says: There was a disagreement between Sayyiduna Zaid bin Thabit and Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) regarding the woman who becomes menstruating after performing the Tawaf al-Ziyarah. Sayyiduna Zaid (may Allah be pleased with him) said: Before departure, her last act should be the Tawaf of the House of Allah. And Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: If she has performed the Tawaf on the day of sacrifice, then she may depart whenever she wishes. When the Ansar saw this disagreement, they said: O Ibn Abbas! We will not follow you, because you oppose Zaid. He said: You people should ask the lady of your family, Sayyida Umm Sulaym (may Allah be pleased with her). Sayyida Umm Sulaym (may Allah be pleased with her) said: I too experienced menstruation after performing the Tawaf of the House of Allah on the day of sacrifice, and the Prophet (peace and blessings be upon him) ordered me to depart (without performing the farewell Tawaf). Similarly, when Sayyida Safiyyah (may Allah be pleased with her) became menstruating, Sayyida Aisha (may Allah be pleased with her) said to her: Woe to you, indeed you are going to detain us. When the Messenger of Allah (peace and blessings be upon him) was informed of this, he said: Order her to depart.
Hadith 4589
عَنْ طَاوُوسٍ قَالَ: كُنْتُ مَعَ ابْنِ عَبَّاسٍ إِذْ قَالَ لَهُ زَيْدُ بْنُ ثَابِتٍ: أَنْتَ تُفْتِي أَنْ تَصْدُرَ الْحَائِضُ قَبْلَ أَنْ يَكُونَ آخِرُ عَهْدِهَا بِالْبَيْتِ؟ قَالَ: نَعَمْ قَالَ: فَلَا تُفْتِ بِذَلِكَ فَقَالَ لَهُ ابْنُ عَبَّاسٍ: إِمَّا لَا فَسَلْ فُلَانَةَ الْأَنْصَارِيَّةَ هَلْ أَمَرَهَا بِذَلِكَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ؟ فَرَجَعَ إِلَيْهِ زَيْدُ بْنُ ثَابِتٍ يَضْحَكُ وَيَقُولُ: مَا أُرَاكَ إِلَّا قَدْ صَدَقْتَ
Tawoos says: I was with Sayyiduna Abdullah bin Abbas (may Allah be pleased with them), when Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said to him: Do you give the fatwa that a menstruating woman can leave without performing the Tawaf of the House of Allah? He said: Yes. He (Zaid) said: Do not give this fatwa. Sayyiduna Ibn Abbas (may Allah be pleased with them) said: If you do not believe me, then ask such-and-such Ansari woman, did the Messenger of Allah (peace and blessings be upon him) command her regarding this matter? Sayyiduna Zaid returned from there laughing and saying: I think you have spoken the truth.
Hadith 4590
عَنْ عَائِشَةَ أَنَّهَا قَالَتْ: لَمَّا أَرَادَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنْ يَنْفِرَ رَأَى صَفِيَّةَ عَلَى بَابِ خِبَائِهَا كَئِيبَةً أَوْ حَزِينَةً وَحَاضَتْ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((عَقْرَى أَوْ حَلْقَى إِنَّكِ لَحَابِسَتُنَا أَكُنْتِ أَفَضْتِ يَوْمَ النَّحْرِ؟)) قَالَتْ: نَعَمْ قَالَ: ((فَانْفِرِي إِذًا))
It is narrated from Sayyida Aisha (may Allah be pleased with her) that when the Messenger of Allah (peace and blessings be upon him) intended to depart after completing the Farewell Pilgrimage, he saw that Sayyida Safiyyah (may Allah be pleased with her) was standing at the door of her tent in a state of sadness. In fact, she had begun menstruating. The Prophet (peace and blessings be upon him) said: "O barren woman, have you detained us?" Did you perform the Tawaf al-Ifadah on the Day of Sacrifice? She replied: "Yes." The Prophet (peace and blessings be upon him) said: "Then depart."
Hadith 4591
عَنِ الْوَلِيدِ بْنِ عَبْدِ الرَّحْمَنِ عَنِ الْحَارِثِ بْنِ عَبْدِ اللَّهِ بْنِ أَوْسٍ الثَّقَفِيِّ رَضِيَ اللَّهُ عَنْهُ قَالَ: سَأَلْتُ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ عَنِ الْمَرْأَةِ تَطُوفُ بِالْبَيْتِ ثُمَّ تَحِيضُ؟ قَالَ: لِيَكُنْ آخِرُ عَهْدِهَا الطَّوَافَ بِالْبَيْتِ قُلْتُ: كَذَلِكَ أَفْتَانِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ: أَرَبْتَ عَنْ يَدَيَّ سَأَلْتَنِي عَنْ شَيْءٍ سَأَلْتَ عَنْهُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لِكَيْ مَا أُخَالِفَ
. (Second chain) When the Messenger of Allah (peace and blessings be upon him) completed the Tawaf al-Ifadah, he wished to do with Lady Safiyyah (may Allah be pleased with her) what a husband does with his wife (the narrator meant the fulfillment of marital rights), but when it was said to him that she was menstruating, he (peace and blessings be upon him) said: "O infertile woman, will this prevent us?" Then people informed that the Lady had performed Tawaf al-Ifadah on the Day of Sacrifice, so he (peace and blessings be upon him) departed along with her.
Hadith 4592
(وَمِنْ طَرِيقٍ ثَانٍ) قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((مَنْ حَجَّ الْبَيْتَ أَوِ اعْتَمَرَ فَلْيَكُنْ آخِرُ عَهْدِهِ الطَّوَافَ بِالْبَيْتِ)) فَقَالَ لَهُ عُمَرُ بْنُ الْخَطَّابِ: خَرَرْتَ مِنْ يَدَيَّ سَمِعْتَ هَذَا مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ ثُمَّ لَمْ تُحَدِّثْنِي (وَفِي لَفْظٍ) فَلَمْ تُخْبِرْنَا بِهِ
(Third chain) Sayyida Aisha (may Allah be pleased with her) said: Sayyida Safiyyah (may Allah be pleased with her) became menstruating after performing the Tawaf al-Ziyarah. When I informed the Messenger of Allah (peace and blessings be upon him) about her menstruation, he (peace and blessings be upon him) said: "Is she the one who will detain us?" I said: "Yes, she became menstruating after performing the Tawaf al-Ifadah." He (peace and blessings be upon him) said: "Then she may depart." In another narration, it is: "Then there is no harm in her departing."
