فَصْلٌ مِنْهُ فِي جَوَازِ أَكْلِ صَيْدِ الْبَرِّ إِذَا لَمْ يَصِدْهُ أَوْ يُصَدْ لَهُ
Section: Permissibility of Eating Land Game If He Did Not Hunt It or It Was Not Hunted for Him
Hadith 4295
عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ (وَفِي لَفْظٍ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ): ((صَيْدُ الْبَرِّ لَكُمْ حَلَالٌ، قَالَ سَعِيدٌ، وَأَنْتُمْ حُرُمٌ مَا لَمْ تَصِيدُوهُ أَوْ يُصَدْ لَكُمْ))
Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: If you are in the state of Ihram, then land game will be lawful for you only in the case that neither you hunt it yourself nor is it hunted for your sake.
Hadith 4296
عَنْ عَبْدِ اللَّهِ بْنِ أَبِي قَتَادَةَ قَالَ: أَحْرَمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَامَ الْحُدَيْبِيَةِ وَلَمْ يُحْرِمْ أَبُو قَتَادَةَ، قَالَ: وَحُدِّثَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنَّ عَدُوًّا بِغَيْقَةَ، فَانْطَلَقَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَبَيْنَمَا أَنَا مَعَ أَصْحَابِي فَضَحِكَ بَعْضُهُمْ إِلَى بَعْضٍ، فَنَظَرْتُ فَإِذَا أَنَا بِحِمَارِ وَحْشٍ فَاسْتَعَنْتُهُمْ فَأَبَوْا أَنْ يُعِينُونِي، فَحَمَلْتُ عَلَيْهِ فَأَثْبَتُّهُ فَأَكَلْنَا مِنْ لَحْمِهِ وَخَشِينَا أَنْ نُقْتَطَعَ، فَانْطَلَقْتُ أَطْلُبُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَجَعَلْتُ أَرْفَعُ فَرَسِي شَأْوًا وَأَسِيرُ شَأْوًا، وَلَقِيتُ رَجُلًا مِنْ بَنِي غِفَارٍ فِي جَوْفِ اللَّيْلِ فَقُلْتُ أَيْنَ تَرَكْتَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ؟ قَالَ: تَرَكْتُهُ وَهُوَ بِتِعْهِنَ، وَهُوَ مِمَّا يَلِي السُّقْيَا، فَأَدْرَكْتُهُ فَقُلْتُ: يَا رَسُولَ اللَّهِ! إِنَّ أَصْحَابَكَ يُقْرِئُونَكَ السَّلَامَ وَرَحْمَةَ اللَّهِ، وَقَدْ خَشُوا أَنْ يُقْتَطَعُوا دُونَكَ فَانْتَظِرْهُمْ، قَالَ: فَانْتَظَرَهُمْ، قُلْتُ وَقَدْ أَصَبْتُ حِمَارَ وَحْشٍ وَعِنْدِي مِنْهُ فَاضِلَةٌ، فَقَالَ لِلْقَوْمِ: ((كُلُوا وَهُمْ مُحْرِمُونَ))
It is narrated from Sayyiduna Abdullah bin Abi Qatadah that the Messenger of Allah, peace and blessings be upon him, entered into the state of Ihram in the year of Hudaybiyyah, while Abu Qatadah had not entered into Ihram. The Messenger of Allah, peace and blessings be upon him, was informed that the enemy was at the place of Ghaiqah, so he set out. I was with my companions when they began to look at each other and laugh. When I also turned my attention there, I saw a wild donkey. I sought their help, but they refused to help me in hunting it. Nevertheless, I chased it and killed it. We ate its meat, but we feared that we might be attacked (i.e., because our number was small, the enemy might harm us), so I set out in search of the Messenger of Allah, peace and blessings be upon him. I would sometimes make my horse run fast and sometimes walk slowly. At night, I met a man from Banu Ghifar. I asked him: At what place did you meet the Messenger of Allah, peace and blessings be upon him? He informed me that he had left him at the place of Ta‘hin near Suqya. I found the Messenger of Allah, peace and blessings be upon him, at that place and said: O Messenger of Allah! Your companions convey to you their greetings and the mercy of Allah. They feared that the enemy might attack them, so please wait for them here. Thus, the Messenger of Allah, peace and blessings be upon him, waited for them there. I said: I had hunted a wild donkey, and a portion of it remains with me. The Messenger of Allah, peace and blessings be upon him, said: Eat it. Although they were in the state of Ihram.
Hadith 4297
(وَمِنْ طَرِيقٍ ثَانٍ) عَنْ مَعْبَدِ بْنِ كَعْبِ بْنِ مَالِكٍ عَنْ أَبِي قَتَادَةَ الْحَارِثِ بْنِ رِبْعِيٍّ رَضِيَ اللَّهُ عَنْهُ قَالَ: بَعَثَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِلَى سِيفِ الْبَحْرِ، فِي بَعْضِ عُمَرِهِ إِلَى مَكَّةَ وَوَعَدَنَا أَنْ نَلْقَاهُ بِقُدَيْدٍ فَخَرَجْنَا وَمِنَّا الْحَلَالُ وَمِنَّا الْحَرَامُ، قَالَ: فَكُنْتُ حَلَالًا، فَذَكَرَ الْحَدِيثَ وَقَالَ فِيهِ: هَذِهِ الْعَضُدُ قَدْ شَوَيْتُهَا وَأَنْضَجْتُهَا وَأَطْيَبْتُهَا، قَالَ: ((فَهَاتِهَا)) قَالَ: فَجِئْتُهُ بِهَا فَنَهَسَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَهُوَ حَرَامٌ حَتَّى فَرَغَ مِنْهَا
(Second chain) It is narrated from Ma’bad bin Ka’b that Sayyiduna Abu Qatadah Harith bin Rabi’i (may Allah be pleased with him) says: The Messenger of Allah (peace and blessings be upon him) sent us on a journey towards the seashore for ‘Umrah, while he (peace and blessings be upon him) himself was heading towards Makkah Mukarramah, and he took a promise from us that we would meet him (peace and blessings be upon him) at the place of Qudayd. So we set out; some of us were in the state of Ihram and some were not, and I was among those who were not in Ihram, … . After that, the whole hadith is narrated and it is said: This is its leg, I roasted and cooked it well and made it good, so the Prophet (peace and blessings be upon him) said: Bring it here. When I brought it to him (peace and blessings be upon him), he began to eat it until he finished it, while he (peace and blessings be upon him) was in the state of Ihram.
Hadith 4298
(وَمِنْ طَرِيقٍ ثَالِثٍ) عَنْ نَافِعٍ مَوْلَى أَبِي قَتَادَةَ الْأَنْصَارِيِّ عَنْ أَبِي قَتَادَةَ أَنَّهُ كَانَ مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ حَتَّى إِذَا كَانَ بِبَعْضِ طُرُقِ مَكَّةَ، تَخَلَّفَ مَعَ أَصْحَابٍ لَهُ مُحْرِمِينَ وَهُوَ غَيْرُ مُحْرِمٍ فَرَأَى حِمَارًا وَحْشِيًّا فَاسْتَوَى عَلَى فَرَسِهِ وَسَأَلَ أَصْحَابَهُ أَنْ يُنَاوِلُوهُ سَوْطَهُ فَأَبَوْا فَسَأَلَهُمْ رُمْحَهُ فَأَبَوْا، فَأَخَذَهُ، ثُمَّ شَدَّ عَلَى الْحِمَارِ فَقَتَلَهُ فَأَكَلَ بَعْضُ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَأَبَى بَعْضُهُمْ، فَلَمَّا أَدْرَكُوا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ سَأَلُوهُ عَنْ ذَلِكَ، فَقَالَ: ((إِنَّمَا هِيَ طُعْمَةٌ، أَطْعَمَكُمُوهَا اللَّهُ عَزَّ وَجَلَّ))
(Third chain) It is narrated from Sayyiduna Abu Qatadah (may Allah be pleased with him), he says: I was on a journey with the Messenger of Allah (peace and blessings be upon him), and he (peace and blessings be upon him) was on one of the routes to Makkah. I lagged behind with some of my friends; the other people were in the state of ihram, but I was not in ihram. I saw a wild donkey and mounted my horse straight away and said to my friends: Hand me my stick, but they refused to do so. I said: Hand me my spear, but they also refused to do this. I dismounted myself, picked up the spear, and attacked the wild donkey, and eventually hunted it. Some of the companions ate from it, but some refused to eat it. When these people reached the Messenger of Allah (peace and blessings be upon him), they asked him about this matter. He (peace and blessings be upon him) said: This was food which Allah Almighty had fed you.
Hadith 4299
(وَمِنْ طَرِيقٍ رَابِعٍ) عَنْ عَطَاءِ بْنِ يَسَارٍ عَنْ أَبِي قَتَادَةَ بِنَحْوِهِ (وَفِيهِ) أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ: ((هَلْ مَعَكُمْ مِنْ لَحْمِهِ مِنْ شَيْءٍ؟))
(Fourth chain) In this it is stated, the Messenger of Allah, peace and blessings be upon him, asked: Do you have any portion of its meat remaining?
Hadith 4300
عَنْ عَبْدِ اللَّهِ بْنِ أَبِي قَتَادَةَ عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُ قَالَ: خَرَجْتُ مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ زَمَنَ الْحُدَيْبِيَةِ فَأَحْرَمَ أَصْحَابِي وَلَمْ أُحْرِمْ، فَرَأَيْتُ حِمَارًا فَحَمَلْتُ عَلَيْهِ فَاصْطَدْتُهُ فَذَكَرْتُ شَأْنَهُ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَذَكَرْتُ أَنِّي لَمْ أَكُنْ أَحْرَمْتُ وَإِنَّمَا اصْطَدْتُهُ لَكَ، فَأَمَرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَصْحَابَهُ فَأَكَلُوا وَلَمْ يَأْكُلْ مِنْهُ حِينَ أَخْبَرْتُهُ أَنِّي اصْطَدْتُهُ لَهُ
It is narrated from Sayyiduna Abu Qatadah (may Allah be pleased with him), he says: I set out on a journey in the company of the Messenger of Allah (peace and blessings be upon him) in the year of Hudaybiyyah. My companions had put on ihram, but I had not put on ihram. During the journey, I saw a wild donkey and attacked it and hunted it. Then I mentioned this incident to the Messenger of Allah (peace and blessings be upon him) and informed him that I was not in the state of ihram and that I hunted it for your sake. The Messenger of Allah (peace and blessings be upon him) said to his companions: Eat it. So the companions ate it, but the Messenger of Allah (peace and blessings be upon him) did not eat it, and the reason was that I had informed him that I hunted it for his sake.
Hadith 4301
عَنْ عُمَيْرِ بْنِ سَلَمَةَ الضَّمْرِيِّ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَرَّ بِالْعَرْجِ، فَإِذَا هُوَ بِحِمَارٍ عَقِيرٍ، فَلَمْ يَلْبَثْ أَنْ جَاءَ رَجُلٌ مِنْ بَهْزٍ، فَقَالَ: يَا رَسُولَ اللَّهِ! هَذِهِ رَمْيَتِي فَشَأْنُكُمْ بِهَا، فَأَمَرَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَبَا بَكْرٍ رَضِيَ اللَّهُ عَنْهُ فَقَسَّمَهُ بَيْنَ الرِّفَاقِ، ثُمَّ سَارَ حَتَّى أَتَى عُقْبَةَ أُثَايَةَ، فَإِذَا هُوَ بِظَبْيٍ فِيهِ سَهْمٌ وَهُوَ حَاقِفٌ فِي ظِلِّ صَخْرَةٍ، فَأَمَرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ رَجُلًا مِنْ أَصْحَابِهِ فَقَالَ: ((قِفْ هَاهُنَا حَتَّى يَمُرَّ الرِّفَاقُ لَا يَرْمِيهِ أَحَدٌ بِشَيْءٍ))
It is narrated from Sayyiduna Umair bin Salamah Zumri that the Messenger of Allah, peace and blessings be upon him, was at the place of ‘Arj when there was a hunted wild donkey lying there. After a short while, a man from Banu Bahz came there. He said: O Messenger of Allah! I had shot an arrow at it, and it fell down here. Please eat it, O Messenger of Allah, peace and blessings be upon him. So the Messenger of Allah, peace and blessings be upon him, ordered Sayyiduna Abu Bakr, may Allah be pleased with him, and he distributed its meat among the fellow travelers. After that, the Messenger of Allah, peace and blessings be upon him, moved forward. When he, peace and blessings be upon him, reached the pass of Athayah, there he, peace and blessings be upon him, saw a deer. It had been struck by an arrow and was standing with its head bowed under the shade of a rock. The Messenger of Allah, peace and blessings be upon him, said to one of his companions: Stand here so that people may pass by and none of them may throw anything at it.
Hadith 4302
عَنْ عَبْدِ الرَّحْمَنِ بْنِ عُثْمَانَ قَالَ: كُنَّا مَعَ طَلْحَةَ بْنِ عُبَيْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُ وَنَحْنُ حُرُمٌ فَأُهْدِيَ لَهُ طَيْرٌ وَطَلْحَةُ رَاقِدٌ، فَمِنَّا مَنْ أَكَلَ وَمِنَّا مَنْ تَوَزَّعَ فَلَمْ يَأْكُلْ، فَلَمَّا اسْتَيْقَظَ طَلْحَةُ وَفَّقَ مَنْ أَكَلَهُ وَقَالَ: أَكَلْنَاهُ مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ
Abdur Rahman bin Uthman says: We were traveling in the state of Ihram with Sayyiduna Talha bin Ubaidullah (may Allah be pleased with him), when a hunted bird was presented to him as a gift. Sayyiduna Talha (may Allah be pleased with him) was asleep at that time. Some of us ate it, and some divided their share and did not eat it. When Sayyiduna Talha (may Allah be pleased with him) woke up, he approved of those who had eaten the game and said: We also ate the meat of such game with the Messenger of Allah (peace and blessings be upon him).
Hadith 4303
عَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ قَالَ: أُتِيَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِلَحْمِ صَيْدٍ وَهُوَ مُحْرِمٌ فَلَمْ يَأْكُلْهُ
Sayyiduna Ali (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) was in the state of ihram when game meat was presented to him. He (peace and blessings be upon him) did not eat it.
Hadith 4304
عَنْ مُعَاوِيَةَ بْنِ قُرَّةَ عَنْ رَجُلٍ مِنَ الْأَنْصَارِ أَنَّ رَجُلًا أَوْطَأَ بَعِيرَهُ أُدْحِيَّ نَعَامٍ وَهُوَ مُحْرِمٌ فَكَسَرَ بَيْضَهَا، فَانْطَلَقَ إِلَى عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ فَسَأَلَهُ عَنْ ذَلِكَ، فَقَالَ لَهُ عَلِيٌّ: عَلَيْكَ بِكُلِّ بَيْضَةٍ جَنِينُ نَاقَةٍ أَوْ ضِرَابُ نَاقَةٍ، فَانْطَلَقَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَذَكَرَ ذَلِكَ لَهُ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((قَدْ قَالَ عَلِيٌّ بِمَا سَمِعْتَ، وَلَكِنْ هَلُمَّ إِلَى الرُّخْصَةِ عَلَيْكَ بِكُلِّ بَيْضَةٍ صَوْمٌ، أَوْ إِطْعَامُ مِسْكِينٍ))
An Ansari man narrates that a man's camel broke ostrich eggs while the man riding it was in the state of Ihram. He went to Sayyiduna Ali (may Allah be pleased with him) and asked him about this issue. Sayyiduna Ali (may Allah be pleased with him) said to him: For each egg, pay as compensation the fetus (i.e., unborn calf) of a she-camel. After that, the man went to the Messenger of Allah (peace and blessings be upon him) and related the entire incident to him. The Messenger of Allah (peace and blessings be upon him) said: You have already heard what Ali said, but now come towards concession and ease, and that is, for each egg, either fast one day or feed one needy person.
Hadith 4305
عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ: كُنَّا مَعَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِي حَجٍّ أَوْ عُمْرَةٍ فَاسْتَقْبَلَنَا رِجْلٌ مِنْ جَرَادٍ فَجَعَلْنَا نَضْرِبُهُنَّ بِعَصِيِّنَا وَسِيَاطِنَا وَنَقْتُلُهُنَّ وَأُسْقِطَ فِي أَيْدِينَا، فَقُلْنَا: مَا نَصْنَعُ وَنَحْنُ مُحْرِمُونَ؟ فَسَأَلْنَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ: ((لَا بَأْسَ بِصَيْدِ الْبَحْرِ))
It is narrated from Sayyiduna Abu Huraira (may Allah be pleased with him), he says: We were with the Messenger of Allah (peace and blessings be upon him) on a journey for Hajj or Umrah, when a swarm of locusts came before us. We began striking and killing them with our staffs and sticks. Then we felt regret for what we had done and said: We were in the state of Ihram, what have we done? So we asked the Messenger of Allah (peace and blessings be upon him) about this, and he (peace and blessings be upon him) said: There is no harm in hunting from the sea.
