Hadith 4280
عَنْ أَبَانَ بْنِ عُثْمَانَ (بْنِ عَفَّانَ) عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ: ((الْمُحْرِمُ لَا يَنْكِحُ وَلَا يُنْكِحُ وَلَا يَخْطُبُ))
It is narrated from Sayyiduna Uthman bin Affan (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: A person in the state of ihram cannot perform nikah, nor can he arrange nikah for someone else, nor can he send a marriage proposal.
Hadith 4281
عَنْ نُبَيْحِ بْنِ وَهْبٍ عَنْ عُمَرَ بْنِ عُبَيْدِ اللَّهِ بْنِ مَعْمَرٍ وَكَانَ يَخْطُبُ بِنْتَ شَيْبَةَ بْنِ عُثْمَانَ عَلَى ابْنِهِ، فَأَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ وَهُوَ عَلَى الْمَوْسِمِ، فَقَالَ: أَلَا أُرَاهُ أَعْرَابِيًّا، إِنَّ الْمُحْرِمَ لَا يَنْكِحُ وَلَا يُنْكِحُ، أَخْبَرَنِي بِذَلِكَ عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَحَدَّثَنِي نُبَيْحٌ عَنْ أَبِيهِ بِنَحْوِهِ
Nubaih bin Wahb says: Umar bin Ubaidullah wanted to arrange the marriage of his son (Talha) with the daughter of Shaibah bin Uthman, so he sent a message to Aban bin Uthman, who was at that time the Amir of Hajj. He said: I think this person is also a Bedouin (ignorant of the Shari'ah rulings). The fact is that a Muhrim can neither marry nor arrange a marriage. Sayyiduna Uthman (may Allah be pleased with him) narrated this to me from the Prophet Muhammad (peace and blessings be upon him).
Hadith 4282
عَنْ عِكْرِمَةَ بْنِ خَالِدٍ قَالَ: سَأَلْتُ عَبْدَ اللَّهِ بْنَ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا عَنِ امْرَأَةٍ أَرَادَ أَنْ يَتَزَوَّجَهَا رَجُلٌ وَهُوَ خَارِجٌ مِنْ مَكَّةَ، فَأَرَادَ أَنْ يَعْتَمِرَ أَوْ يَحُجَّ، فَقَالَ: لَا تَتَزَوَّجْهَا وَأَنْتَ مُحْرِمٌ، نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ
Ikrimah bin Khalid says: I asked Sayyiduna Abdullah bin Umar (may Allah be pleased with him), while he was outside Makkah, that a man wants to marry a woman, and now his intention is that he also performs Umrah and Hajj (and then marries while in the state of Ihram). Sayyiduna Abdullah bin Umar (may Allah be pleased with him) said: You cannot marry her while in the state of Ihram, because the Messenger of Allah (peace and blessings be upon him) forbade doing so.
Hadith 4283
عَنْ عِكْرَمَةَ عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا أَنَّهُ كَانَ لَا يَرَى بَأْسًا أَنْ يَتَزَوَّجَ الرَّجُلُ وَهُوَ مُحْرِمٌ وَيَقُولُ إِنَّ نَبِيَّ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ تَزَوَّجَ مَيْمُونَةَ بِنْتَ الْحَارِثِ بِمَاءٍ يُقَالُ لَهُ سَرِفُ، وَهُوَ مُحْرِمٌ، فَلَمَّا قَضَى نَبِيُّ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ حَجَّتَهُ أَقْبَلَ حَتَّى إِذَا كَانَ بِذَلِكَ الْمَاءِ أَعْرَسَ بِهَا
Ikrimah reports that Sayyiduna Abdullah bin Abbas (may Allah be pleased with him) did not consider there to be any harm in marrying while in the state of Ihram, because he said that the Noble Prophet (peace and blessings be upon him) himself married Sayyida Maymunah (may Allah be pleased with her) while in the state of Ihram, and at that time the Prophet (peace and blessings be upon him) was at Sarf near the water. Then, when the Prophet (peace and blessings be upon him) completed his Hajj, he returned to that same water, and it was there that the marriage was consummated.
Hadith 4284
(وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) عَنِ ابْنِ عَبَّاسٍ أَيْضًا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ نَكَحَ مَيْمُونَةَ وَهُوَ مُحْرِمٌ وَبَنَى بِهَا حَلَالًا بِسَرِفَ وَمَاتَتْ بِسَرِفَ
(Second chain) It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) married Sayyida Maymunah (may Allah be pleased with her) while in the state of Ihram, but when he secluded himself with her at the place of Sarif, at that time he (peace and blessings be upon him) was out of Ihram. Later, Sayyida Maymunah (may Allah be pleased with her) passed away at the same place of Sarif.
Hadith 4285
(وَعَنْهُ مِنْ طَرِيقٍ ثَالِثٍ) عَنِ ابْنِ عَبَّاسٍ أَيْضًا أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ تَزَوَّجَ مَيْمُونَةَ بِنْتَ الْحَارِثِ وَهُمَا مُحْرِمَانِ
(Third chain) It is narrated from Sayyiduna Abdullah bin Abbas, may Allah be pleased with him, that when the Noble Prophet, peace and blessings be upon him, married Sayyidah Maymunah bint Harith, may Allah be pleased with her, both of them were in the state of Ihram.
Hadith 4286
عَنْ يَزِيدَ بْنِ الْأَصَمِّ عَنْ مَيْمُونَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ تَزَوَّجَهَا حَلَالًا، وَبَنَى بِهَا حَلَالًا وَمَاتَتْ بِسَرِفَ فَدَفَنَّاهَا فِي الظُّلَّةِ الَّتِي بَنَى بِهَا فِيهَا، فَنَزَلْنَا فِي قَبْرِهَا أَنَا وَابْنُ عَبَّاسٍ
Yazid bin Asam narrates that the wife of the Messenger, Sayyida Maymunah (may Allah be pleased with her), used to state that when the Messenger of Allah (peace and blessings be upon him) married her, he was in a state of being halal (not in ihram), and likewise, when he had privacy with her, he was also not in a state of ihram. Later, Sayyida Maymunah (may Allah be pleased with her) also passed away at the place of Saraf. We buried her in the same shade where the Messenger of Allah (peace and blessings be upon him) had spent the night with her. I and Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) had descended into her grave.
Hadith 4287
عَنْ أَبِي رَافِعٍ رَضِيَ اللَّهُ عَنْهُ مَوْلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ تَزَوَّجَ مَيْمُونَةَ حَلَالًا وَبَنَى بِهَا حَلَالًا وَكُنْتُ الرَّسُولَ بَيْنَهُمَا
Mawla of the Messenger, Sayyiduna Abu Rafi’ (may Allah be pleased with him) narrates: He says, when the Messenger of Allah (peace and blessings be upon him) married Sayyida Maymunah (may Allah be pleased with her) and when he was alone with her, he (peace and blessings be upon him) was lawful, that is, he was not in the state of ihram, and I was the messenger between the two of them.
