الرُّخْصَةُ فِي الْقُبْلَةِ وَالْمُبَاشَرَةِ لِلصَّائِمِ إِلَّا لِمَنْ يَخَافُ عَلَى نَفْسِهِ
Concession for Kissing and Physical Contact for the Fasting Person Except for One Who Fears for Himself
Hadith 3773
عَنْ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ قَالَ: هَشَشْتُ يَوْمًا فَقَبَّلْتُ وَأَنَا صَائِمٌ فَأَتَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقُلْتُ: صَنَعْتُ الْيَوْمَ أَمْرًا عَظِيمًا فَقَبَّلْتُ وَأَنَا صَائِمٌ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((أَرَأَيْتَ لَوْ تَمَضْمَضْتَ بِمَاءٍ وَأَنْتَ صَائِمٌ؟)) قُلْتُ: لَا بَأْسَ بِذَلِكَ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((فَفِيمَ))
Sayyiduna Umar bin Khattab, may Allah be pleased with him, says: One day I felt comfort and energy, so I kissed my wife while I was fasting. Then I went to the service of the Noble Prophet, peace and blessings be upon him, and said: Today I have done a great thing, and that is that I kissed my wife while I was fasting. The Messenger of Allah, peace and blessings be upon him, said: If you rinse your mouth with water while fasting, what do you think about that? I said: There is no harm in it. The Messenger of Allah, peace and blessings be upon him, said: Then what are you asking about (regarding this kiss)? That is, there is no harm in kissing either.
Hadith 3774
عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ كَانَ يُبَاشِرُ وَهُوَ صَائِمٌ ثُمَّ يَجْعَلُ بَيْنَهُ وَبَيْنَهَا ثَوْبًا تَعْنِي الْفَرْجَ
Sayyidah Aisha (may Allah be pleased with her) says that the Messenger of Allah (peace and blessings be upon him) in the state of fasting would have physical intimacy (with his wife), that is, would join body to body, but would place a cloth between his and her private parts.
Hadith 3775
عَنْ إِبْرَاهِيمَ عَنْ عَلْقَمَةَ: خَرَجَ عَلْقَمَةُ وَأَصْحَابُهُ حُجَّاجًا فَذَكَرَ بَعْضُهُمْ: الصَّائِمَ يُقَبِّلُ وَيُبَاشِرُ فَقَالَ رَجُلٌ مِنْهُمْ، قَدْ قَامَ سَنَتَيْنِ وَصَامَهُمَا هَمَمْتُ أَنْ آخُذَ قَوْسِي فَأَضْرِبَكَ بِهَا قَالَ: فَكُفُّوا حَتَّى تَأْتُوا عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، فَدَخَلُوا عَلَى عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا فَسَأَلُوهَا عَنْ ذَلِكَ فَقَالَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا: كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُبِّلُ وَيُبَاشِرُ وَكَانَ أَمْلَكَكُمْ لِإِرْبِهِ، قَالُوا: يَا أَبَا شِبْلٍ! سَلْهَا، قَالَ: لَا أَرْفُثُ عِنْدَهَا الْيَوْمَ، فَسَأَلُوهَا فَقَالَتْ: كَانَ يُقَبِّلُ وَيُبَاشِرُ وَهُوَ صَائِمٌ
Alqamah and his companions set out for Hajj. Someone said: A fasting person can kiss (his wife) and can also lie with her. One of them, who had spent two years in residence and was diligent in fasting, upon hearing this said: I have intended to take my bow and strike you with it. Alqamah said: Refrain from discussing this issue until we reach Lady Aisha (may Allah be pleased with her). Eventually, all those people presented themselves before Lady Aisha (may Allah be pleased with her) and inquired about this issue. Lady Aisha (may Allah be pleased with her) said: The Messenger of Allah (peace and blessings be upon him) used to kiss and have intimacy while fasting; however, he (peace and blessings be upon him) had more control over his desires than all of you. The companions said: Abu Shibl! Now ask Lady Aisha (may Allah be pleased with her) yourself. But he said: Today, I will not engage in such conversation at her place. Then they asked the question, and Lady Aisha (may Allah be pleased with her) said: The Messenger of Allah (peace and blessings be upon him) used to kiss and have intimacy while fasting.
Hadith 3776
عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا قَالَتْ: أَهْوَى إِلَيَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لِيُقَبِّلَنِي فَقُلْتُ: إِنِّي صَائِمَةٌ، فَقَالَ: وَأَنَا صَائِمٌ، قَالَتْ: فَأَهْوَى إِلَيَّ فَقَبَّلَنِي
Sayyida Aisha (may Allah be pleased with her) says: The Messenger of Allah (peace and blessings be upon him) leaned towards me to kiss me. I said: I am fasting. He (peace and blessings be upon him) said: I am also fasting. Then he (peace and blessings be upon him) leaned towards me and kissed me.
Hadith 3777
(وَعَنْهَا مِنْ طَرِيقٍ ثَانٍ): أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَبَّلَ امْرَأَةً مِنْ نِسَائِهِ وَهُوَ صَائِمٌ ثُمَّ ضَحِكَتْ
(Second chain) Sayyida Aisha (may Allah be pleased with her) says: The Messenger of Allah (peace and blessings be upon him) kissed his wife while he was in the state of fasting, then Sayyida Aisha (may Allah be pleased with her) laughed.
Hadith 3778
(وَعَنْهَا مِنْ طَرِيقٍ ثَالِثٍ) قَالَ: إِنْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَيَظَلُّ صَائِمًا ثُمَّ يُقَبِّلُ مَا شَاءَ مِنْ وَجْهِي حَتَّى يُفْطِرَ
(Third chain) Sayyida Aisha (may Allah be pleased with her) says: The Messenger of Allah (peace and blessings be upon him and his family) used to fast, and then until breaking the fast, he would kiss my face as much as he wished.
Hadith 3779
حَدَّثَنَا عَبْدُ اللَّهِ حَدَّثَنِي أَبِي ثَنَا عَفَّانُ قَالَ: ثَنَا مُحَمَّدُ بْنُ دِينَارٍ عَنْ سَعْدِ بْنِ أَوْسٍ عَنْ مِصْدَعٍ أَبِي يَحْيَى الْأَنْصَارِيِّ عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ كَانَ يُقَبِّلُهَا وَهُوَ صَائِمٌ وَيَمُصُّ لِسَانَهَا، قُلْتُ: سَمِعْتَهُ مِنْ سَعْدِ بْنِ أَوْسٍ؟ قَالَ: نَعَمْ
Sayyida Aisha (may Allah be pleased with her) narrates that the Messenger of Allah (peace and blessings be upon him) used to kiss her while he was fasting and used to suck her tongue. Affan says: I asked Muhammad bin Dinar, "Did you hear this hadith directly from Saad bin Aws?" He replied: "Yes."
Hadith 3780
حَدَّثَنَا عَبْدُ اللَّهِ حَدَّثَنِي أَبِي ثَنَا سُفْيَانُ قَالَ: قُلْتُ لِعَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ: أَسَمِعْتَ أَبَاكَ يُحَدِّثُ عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ كَانَ يُقَبِّلُهَا وَهُوَ صَائِمٌ فَسَكَتَ هُنَيَّةً، ثُمَّ قَالَ: نَعَمْ
Imam Sufyan said to Abdur Rahman bin Qasim: Did you hear your father narrate this hadith from Sayyida Aisha (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) used to kiss her while he was fasting? Upon hearing this, Abdur Rahman bin Al-Qasim remained silent for a while, then said: Yes.
Hadith 3781
عَنْ أَبِي قَيْسٍ قَالَ: أَرْسَلَنِي عَبْدُ اللَّهِ بْنُ عَمْرٍو رَضِيَ اللَّهُ عَنْهُ إِلَى أُمِّ سَلَمَةَ أَسْأَلُهَا، هَلْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يُقَبِّلُ وَهُوَ صَائِمٌ؟ فَإِنْ قَالَتْ: لَا، فَقُلْ لَهَا إِنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا تُخْبِرُ النَّاسَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ كَانَ يُقَبِّلُ وَهُوَ صَائِمٌ؟ قَالَ: فَسَأَلْتُهَا أَكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يُقَبِّلُ وَهُوَ صَائِمٌ؟ قَالَتْ: لَا، قُلْتُ: إِنَّ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا تُخْبِرُ النَّاسَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَعَلَى آلِهِ وَصَحْبِهِ وَسَلَّمَ كَانَ يُقَبِّلُ وَهُوَ صَائِمٌ قَالَتْ: لَعَلَّهُ إِيَّاهَا، كَانَ لَا يَتَمَالَكَ عَنْهَا حُبًّا، أَمَّا إِيَّايَ فَلَا
Abu Qais says: Sayyiduna Abdullah bin Amr (may Allah be pleased with him) sent me to Sayyida Umm Salamah (may Allah be pleased with her) so that I could ask her whether the Messenger of Allah (peace and blessings be upon him) used to kiss while fasting. If she answers in the negative, then say to her that Sayyida Aisha (may Allah be pleased with her) tells people that the Messenger of Allah (peace and blessings be upon him) used to kiss while fasting. So I went and asked Sayyida Umm Salamah (may Allah be pleased with her): Did the Messenger of Allah (peace and blessings be upon him) use to kiss while fasting? She said: No. I said: But Sayyida Aisha (may Allah be pleased with her) tells people that the Messenger of Allah (peace and blessings be upon him) used to kiss while fasting. She said: It is possible that he (peace and blessings be upon him) used to kiss her, because he (peace and blessings be upon him) loved her very much. As for me, he (peace and blessings be upon him) did not kiss me in that state.
Hadith 3782
عَنْ عَبْدِ اللَّهِ بْنِ فَرُّوخٍ أَنَّ امْرَأَةً سَأَلَتْ أُمَّ سَلَمَةَ رَضِيَ اللَّهُ عَنْهَا فَقَالَتْ: إِنَّ زَوْجِي يُقَبِّلُنِي وَهُوَ صَائِمٌ وَأَنَا صَائِمَةٌ، فَمَا تَرَيْنَ؟ فَقَالَتْ: كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يُقَبِّلُنِي وَهُوَ صَائِمٌ وَأَنَا صَائِمَةٌ
Abdullah bin Farukh says that a woman asked Sayyida Umm Salamah (may Allah be pleased with her) that her husband kisses her while both of them are fasting; what is your opinion about this? She replied: The Messenger of Allah (peace and blessings be upon him) used to kiss me while he was fasting and I was also fasting.
Hadith 3783
عَنْ حَفْصَةَ بِنْتِ عُمَرَ رَضِيَ اللَّهُ عَنْهَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ كَانَ يُقَبِّلُ وَهُوَ صَائِمٌ
It is narrated from Sayyidah Hafsah bint Umar (may Allah be pleased with her) that the Messenger of Allah (peace and blessings be upon him) used to kiss while in the state of fasting.
Hadith 3784
(وَعَنْهَا مِنْ طَرِيقٍ ثَانٍ): أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ كَانَ يَنَالُ مِنْ وَجْهِ بَعْضِ نِسَائِهِ وَهُوَ صَائِمٌ
(Second chain) The Messenger of Allah, peace and blessings be upon him, used to kiss some of his wives while he was fasting.
Hadith 3785
عَنْ أُمِّ حَبِيبَةَ (زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَرَضِيَ اللَّهُ عَنْهَا) أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ كَانَ يُقَبِّلُ وَهُوَ صَائِمٌ
It is narrated from the wife of the Messenger, Sayyida Umm Habibah (may Allah be pleased with her), that the Messenger of Allah (peace and blessings be upon him) used to kiss while in the state of fasting.
Hadith 3786
عَنْ أَيُّوبَ عَنْ شَيْخٍ مِنْ بَنِي سَدُوسٍ قَالَ: سُئِلَ ابْنُ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ عَنِ الْقُبْلَةِ لِلصَّائِمِ فَقَالَ: كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يُصِيبُ مِنَ الرُّؤُوسِ وَهُوَ صَائِمٌ
A Sheikh from Banu Sadoos narrates that when Sayyiduna Abdullah bin Abbas (may Allah be pleased with him) was asked about a fasting person kissing (his wife), he said: The Messenger of Allah (peace and blessings be upon him) used to make use of the upper (bodily parts) while fasting.
Hadith 3787
عَنْ عَطَاءِ بْنِ يَسَارٍ عَنْ رَجُلٍ مِنَ الْأَنْصَارِ أَنَّ الْأَنْصَارِيَّ أَخْبَرَ عَطَاءً: أَنَّهُ قَبَّلَ امْرَأَتَهُ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَهُوَ صَائِمٌ فَسَأَلَتِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَنْ ذَلِكَ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَفْعَلُ ذَلِكَ))، فَأَخْبَرَتْهُ امْرَأَتُهُ فَقَالَ: إِنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يُرَخَّصُ لَهُ فِي أَشْيَاءَ، فَارْجِعِي إِلَيْهِ، فَقُولِي لَهُ، فَرَجَعَتْ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَعَلَى آلِهِ وَصَحْبِهِ وَسَلَّمَ فَقَالَتْ: قَالَ: إِنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يُرَخَّصُ لَهُ فِي أَشْيَاءَ، فَقَالَ: ((أَنَا أَتْقَاكُمْ لِلَّهِ وَأَعْلَمُكُمْ بِحُدُودِ اللَّهِ))
‘Ata bin Yasar says: An Ansari man narrated to me that during the time of the Messenger of Allah, he kissed his wife while fasting. When his wife asked the Prophet Muhammad (peace and blessings be upon him) about this, he (peace and blessings be upon him) said: Indeed, the Messenger of Allah also does so. When his wife went and told him, he said: The Prophet Muhammad (peace and blessings be upon him) is sometimes given special concessions in certain matters, so go and ask again. So she returned to the Prophet Muhammad (peace and blessings be upon him) and said: My husband says that you (peace and blessings be upon him) are given special permission in some matters. Upon hearing this, the Prophet Muhammad (peace and blessings be upon him) said: I am the most fearful of Allah among you and the most knowledgeable of Allah’s limits among you.
