Hadith 5854

عَنْ سَالِمٍ عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُمَا عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ نَخْلًا مُؤَبَّرًا فَالثَّمَرَةُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
Narrated by Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said: Whoever sold a slave and he possesses property, then that property will belong to the seller, unless the buyer stipulates it at the time of the transaction. And whoever sold date-palm trees that have been pollinated, then their fruit will belong to the seller, unless the buyer stipulates it.
