Hadith 9970

عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَنْ تَقَوَّلَ عَلَيَّ مَا لَمْ أَقُلْ فَلْيَتَبَوَّأْ مَقْعَدَهُ مِنَ النَّارِ وَمَنِ اسْتَشَارَهُ أَخُوهُ الْمُسْلِمُ فَأَشَارَ عَلَيْهِ بِغَيْرِ رُشْدٍ فَقَدْ خَانَهُ وَمَنْ أَفْتَى بِفُتْيَا غَيْرِ ثَبْتٍ فَإِنَّمَا إِثْمُهُ عَلَى مَنْ أَفْتَاهُ
Syedna Abu Hurairah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: Whoever attributes to me something which I have not said, let him prepare his abode in the Fire. Whoever is consulted by his Muslim brother, but gives him advice without wisdom and uprightness, then he has betrayed him. And whoever gives a legal verdict without proper investigation, then its sin will be upon the one who gave the verdict.

Brief Explanation
Benefits: … Those who give advice and legal opinions (fatwa) should remain alert; only such advice should be given in which there is good and benefit for the Muslim, and a legal opinion (fatwa) regarding matters related to the Shari‘ah should be given only after complete investigation, effort, and after reaching certainty or a predominant assumption (zann ghalib).
