Hadith 9705

عَنْ رَجُلٍ مِنْ بَنِي سَدُوسٍ يُقَالُ لَهُ دَيْسَمٌ رَضِيَ اللَّهُ عَنْهُ قَالَ قُلْنَا لِبَشِيرِ بْنِ الْخَصَاصِيَةِ قَالَ وَمَا كَانَ اسْمُهُ بَشِيرًا فَسَمَّاهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بَشِيرًا إِنَّ لَنَا جِيرَةً مِنْ بَنِي تَمِيمٍ لَا تَشُذُّ لَنَا قَاصِيَةٌ إِلَّا ذَهَبُوا بِهَا وَإِنَّهَا تُخَالِفُنَا مِنْ أَمْوَالِهِمْ أَشْيَاءَ أَفَنَأْخُذُ قَالَ لَا
It is narrated from a man named Daisam of Banu Sadoos, he says: We said to Sayyiduna Basheer bin Khasasiyyah—this was not his name, the Prophet (peace and blessings be upon him) named him Basheer—anyway, we said: Some people of Banu Tameem are our neighbors, whenever any of our goats strays from the herd, they take it away, so when some of their belongings come to us, can we take possession of them? He said: No, you cannot.

Brief Explanation
Benefits: … The meaning of this man's question is that when he does something whose legal (shar‘i) goodness or evil is hidden, how will he know about such an action whether it is good or bad? Because for those matters which have been clearly declared as good or bad by the Shari‘ah, there is no need for people’s opinions. Also, those who declare such an action to be good or bad should be people of sound nature and righteous conduct, who understand the temperament of the Shari‘ah regarding good and evil.

It is narrated from a man named Daysam from Banu Sadoos; he says: We said to Sayyiduna Basheer bin Khasasiyyah—this was not his (original) name; the Prophet (sallallahu alayhi wa sallam) had named him Basheer—anyway, we said: Some people from Banu Tameem are our neighbors. Whenever one of our goats strays from the herd, they take it. Then, when some of their belongings come to us, can we take possession of them? He replied: No, you may not.
