Hadith 8686

عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو رَضِيَ اللَّهُ عَنْهُمَا قَالَ إِنَّ رَجُلًا مِنْ الْمُسْلِمِينَ اسْتَأْذَنَ نَبِيَّ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِي امْرَأَةٍ يُقَالُ لَهَا أُمُّ مَهْزُولٍ كَانَتْ تُسَافِحُ وَتَشْتَرِطُ لَهُ أَنْ تُنْفِقَ عَلَيْهِ وَأَنَّهُ اسْتَأْذَنَ فِيهَا النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَوْ ذَكَرَ لَهُ أَمْرَهَا فَقَرَأَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ {الزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ} [النور: 3] قَالَ أُنْزِلَتْ {الزَّانِيَةُ لَا يَنْكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ} [النور: 3] قَالَ أَبِي قَالَ عَارِمٌ سَأَلْتُ مُعْتَمِرًا عَنْ الْحَضْرَمِيِّ فَقَالَ كَانَ قَاصًّا وَقَدْ رَأَيْتُهُ
It is narrated from Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) that a Muslim man sought permission from the Noble Prophet (peace and blessings be upon him) as to whether he could marry a woman named Umm Mahzool. This woman was an adulteress and she had stipulated that he would spend on her. When this man sought permission to marry this woman or mentioned her before the Prophet (peace and blessings be upon him), the Prophet (peace and blessings be upon him) recited this verse: {الزَّانِیَۃُ لَا یَنْکِحُہَا إِلَّا زَانٍ أَ وْ مُشْرِکٌ} … Only an adulterer or a polytheist man can marry an adulteress woman. Arim says: I asked Mu’tamir about Hadrami, he said: He was a storyteller and I had seen him.

Brief Explanation
Benefits: … It is narrated from Sayyiduna Abdullah bin Amr bin al-As radi Allahu anhu, who says: “Indeed, Marthad bin Abi Marthad al-Ghanawi used to transport prisoners (of war) from Makkah. In Makkah, there was a prostitute named ‘Anaq, and she was his companion. He said: I came to the Prophet sallallahu alayhi wa sallam and said: O Messenger of Allah! Should I marry ‘Anaq? He sallallahu alayhi wa sallam remained silent towards me. Then this verse was revealed: {وَالزَّانِیَۃُ لَا یَنْکِحُہَا إِلَّا زَانٍ أَ وْ مُشْرِکٌ}. He called me, recited it to me, and said: ‘Do not marry her.’” (Abu Dawud: 1755, Nasa’i: 3228)

Sayyiduna Marthad al-Ghanawi radi Allahu anhu used to transfer Muslim prisoners from Makkah al-Mukarramah, while in Makkah there was a woman named ‘Anaq who was a fornicator; (in the time of ignorance) she had been his friend. Sayyiduna Marthad radi Allahu anhu says: I came to the Noble Prophet sallallahu alayhi wa sallam and said: O Messenger of Allah! Should I marry ‘Anaq? The Prophet sallallahu alayhi wa sallam remained silent towards me. Then this verse was revealed: “And the fornicating woman—none marries her except a fornicator or a polytheist.” The Prophet sallallahu alayhi wa sallam called me, recited these verses to me, and said: “Do not marry her.”
