Hadith 8550

عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُ قَالَ جَاءَتْ امْرَأَةُ سَعْدِ بْنِ الرَّبِيعِ رَضِيَ اللَّهُ عَنْهُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِابْنَتَيْهَا مِنْ سَعْدٍ فَقَالَتْ يَا رَسُولَ اللَّهِ هَاتَانِ ابْنَتَا سَعْدِ بْنِ الرَّبِيعِ قُتِلَ أَبُوهُمَا مَعَكَ فِي أُحُدٍ شَهِيدًا وَإِنَّ عَمَّهُمَا أَخَذَ مَالَهُمَا فَلَمْ يَدَعْ لَهُمَا مَالًا وَلَا يُنْكَحَانِ إِلَّا وَلَهُمَا مَالٌ قَالَ فَقَالَ يَقْضِي اللَّهُ فِي ذَلِكَ فَنَزَلَتْ آيَةُ الْمِيرَاثِ فَأَرْسَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِلَى عَمِّهِمَا فَقَالَ أَعْطِ ابْنَتَيْ سَعْدٍ الثُّلُثَيْنِ وَأُمَّهُمَا الثُّمُنَ وَمَا بَقِيَ فَهُوَ لَكَ
Narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the wife of Sayyiduna Sa’d bin Rabi’ (may Allah be pleased with him) came to the Messenger of Allah (peace and blessings be upon him) with her two daughters and said: O Messenger of Allah! These are the two daughters of Sa’d (may Allah be pleased with him); their father was martyred with you in the Battle of Uhud, and their uncle has taken all their wealth. Obviously, if these girls have no wealth, they will not be able to marry. The Prophet (peace and blessings be upon him) said: Allah Almighty will decide about this matter. Then the verse of inheritance was revealed, and the Messenger of Allah (peace and blessings be upon him) called their uncle and said to him: Give two-thirds to Sa’d’s daughters and one-eighth to their mother, and whatever remains (as ‘asabah) is yours.

Brief Explanation
Benefits: … When the deceased has two or more daughters, they receive two-thirds (of the inheritance). When the husband has children, his wife receives one-eighth. The paternal uncle is an agnate (ʿaṣabah); therefore, whatever remains after the shares of the two categories of fixed-share heirs (aṣḥāb al-furūḍ) will go to the paternal uncle. The science of inheritance (ʿilm al-mīrāth) is a complete and intricate discipline; related verses are found at the beginning and end of Sūrat al-Nisāʾ. Before hadith number (6337), some issues related to this science have already been discussed in the Book of Inheritance (Kitāb al-Farāʾiḍ).
