Hadith 840

حَدَّثَنَا عَبْدُ اللَّهِ قَالَ: حَدَّثَنِي أَبِي قَالَ: ثَنَا يَحْيَى بْنُ آدَمَ قَالَ: ثَنَا زُهَيْرٌ وَابْنُ إِدْرِيسَ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ عَنْ مَعْمَرِ بْنِ أَبِي حَبِيبَةَ عَنْ عُبَيْدِ بْنِ رِفَاعَةَ بْنِ رَافِعٍ عَنْ أَبِيهِ، قَالَ زُهَيْرٌ فِي حَدِيثِهِ رِفَاعَةَ بْنِ رَافِعٍ وَكَانَ عَقَبِيًّا بَدَرِيًّا، قَالَ: كُنْتُ عِنْدَ عُمَرَ فَقِيلَ لَهُ: إِنَّ زَيْدَ بْنَ ثَابِتٍ يُفْتِي النَّاسَ فِي الْمَسْجِدِ، قَالَ زُهَيْرٌ فِي حَدِيثِهِ: يُفْتِي النَّاسَ بِرَأْيِهِ فِي الَّذِي يُجَامِعُ وَلَا يُنْزِلُ، فَقَالَ: أَعْجِلْ بِهِ، فَأُتِيَ بِهِ فَقَالَ: يَا عَدُوَّ نَفْسِهِ! أَوَ قَدْ بَلَغْتَ أَنْ تُفْتِيَ النَّاسَ فِي مَسْجِدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِرَأْيِكَ، قَالَ: مَا فَعَلْتُ وَلَكِنْ حَدَّثَنِي عُمُومَتِي عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ، قَالَ: أَيُّ عُمُومَتِكَ؟ قَالَ: أُبَيُّ بْنُ كَعْبٍ، قَالَ زُهَيْرٌ وَأَبُو أَيُّوبَ وَرِفَاعَةُ بْنُ رَافِعٍ: فَالْتَفَتَ إِلَيَّ وَقَالَ: مَا يَقُولُ هَٰذَا الْفَتَى؟ وَقَالَ زُهَيْرٌ: مَا يَقُولُ هَٰذَا الْغُلَامُ؟ فَقُلْتُ: كُنَّا نَفْعَلُهُ فِي عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ، قَالَ: فَسَأَلْتُمْ عَنْهُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ؟ قَالَ: كُنَّا نَفْعَلُهُ عَلَى عَهْدِهِ فَلَمْ نَغْتَسِلْ، قَالَ: فَجَمَعَ النَّاسَ وَاتَّفَقَ النَّاسُ عَلَى أَنَّ الْمَاءَ لَا يَكُونُ إِلَّا مِنَ الْمَاءِ إِلَّا رَجُلَيْنِ عَلِيَّ بْنَ أَبِي طَالِبٍ وَمُعَاذَ بْنَ جَبَلٍ قَالَا: إِذَا جَاوَزَ الْخِتَانُ الْخِتَانَ فَقَدْ وَجَبَ الْغُسْلُ، قَالَ: فَقَالَ عَلِيٌّ: يَا أَمِيرَ الْمُؤْمِنِينَ! إِنَّ أَعْلَمَ النَّاسِ بِهَٰذَا أَزْوَاجُ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ، فَأَرْسَلَ إِلَى حَفْصَةَ فَقَالَتْ: لَا عِلْمَ لِي، فَأَرْسَلَ إِلَى عَائِشَةَ فَقَالَتْ: إِذَا جَاوَزَ الْخِتَانُ الْخِتَانَ وَجَبَ الْغُسْلُ، قَالَ: فَتَحَطَّمَ عُمَرُ يَعْنِي تَغَيَّظَ ثُمَّ قَالَ: لَا يَبْلُغَنِي أَنَّ أَحَدًا فَعَلَهُ وَلَا يَغْتَسِلُ إِلَّا أَنْهَكْتُهُ عُقُوبَةً
Sayyiduna Rifa’ah bin Rafi’ (may Allah be pleased with him), who participated in the Pledge of Aqabah and the Battle of Badr, narrates: He says, I was with Sayyiduna Umar (may Allah be pleased with him) when someone said to him: Sayyiduna Zaid bin Thabit is giving fatwa in the mosque to people based on his own opinion regarding the man who has intercourse but does not ejaculate. Sayyiduna Umar (may Allah be pleased with him) said: Bring him to me quickly. So they brought him. Sayyiduna Umar (may Allah be pleased with him) said: O enemy of your own soul! Have you reached the point that you have started giving fatwa to people in the Prophet’s Mosque based on your own opinion? He said: I have not done any such thing, but rather my uncles have narrated to me from the Messenger of Allah (peace and blessings be upon him). Sayyiduna Umar (may Allah be pleased with him) said: Which uncles of yours? He said: Sayyiduna Ubayy bin Ka’b, Sayyiduna Abu Ayyub, and Sayyiduna Rifa’ah bin Rafi’ (may Allah be pleased with them). Sayyiduna Umar (may Allah be pleased with him) said: What does this young man say? I replied: Yes, we used to do the same in the time of the Messenger of Allah (peace and blessings be upon him). Sayyiduna Umar (may Allah be pleased with him) said: Then did you ask the Messenger of Allah (peace and blessings be upon him) about this? I said: We used to do the same in the time of the Messenger of Allah (peace and blessings be upon him) and we did not perform ghusl. Then he gathered the people and asked about this matter. It happened that all the people agreed that the water of ghusl was only used when the water of semen was discharged, except for two men, Sayyiduna Ali and Sayyiduna Mu’adh (may Allah be pleased with them). These two said: When the circumcised part touches the circumcised part, ghusl becomes obligatory. Sayyiduna Ali (may Allah be pleased with him) said to Sayyiduna Umar (may Allah be pleased with him): O Commander of the Faithful! The wives of the Messenger of Allah (peace and blessings be upon him) know this matter better. So you sent a message to Sayyidah Hafsah (may Allah be pleased with her) regarding this. She replied: I have no knowledge about this. Then you sent a message to Sayyidah Aisha (may Allah be pleased with her). She said: When the circumcised part touches the circumcised part, ghusl becomes obligatory. Upon hearing this, Sayyiduna Umar (may Allah be pleased with him) became angry and said: Let it not reach me that anyone has done such a thing and then not performed ghusl, otherwise I will give him the severest punishment.
