Hadith 7246

(وَعَنْهُ مِنْ طَرِيقٍ ثَالِثٍ) عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ رَضِيَ اللَّهُ عَنْهَا أَنَّ أَبَا عَمْرٍو بْنَ حَفْصٍ طَلَّقَهَا الْبَتَّةَ وَهُوَ غَائِبٌ فَذَكَرَ مَعْنَاهُ وَقَالَ انْكِحِي أُسَامَةَ بْنَ زَيْدٍ فَكَرِهْتُهُ فَقَالَ انْكِحِي أُسَامَةَ بْنَ زَيْدٍ فَنَكَحْتُهُ فَجَعَلَ اللَّهُ لِي فِيهِ خَيْرًا
. (Third chain) Sayyida Fatima (may Allah be pleased with her) says: Abu Amr bin Hafs gave me an irrevocable divorce and he himself was not present here. Then she mentioned a hadith similar in meaning to the above hadith, and then said: The Prophet (peace and blessings be upon him) said: Marry Usama. I disliked it, but the Prophet (peace and blessings be upon him) again said: Just marry Usama bin Zaid. So I married him on your command, and Allah Almighty created much goodness in it.
Brief Explanation
Benefits: … Sayyiduna Abu Amr ibn Hafs radi Allahu anhu had given his wife three divorces (talaq) in different gatherings. Since after three divorces the husband has no right of taking her back (ruju‘), he is also not responsible for the maintenance (nafaqah) and residence of such a woman. Such a woman may observe her waiting period (‘iddah) at a suitable place other than her husband’s house.
