Hadith 7232

عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمٰنِ أَنَّهُ قَالَ سُئِلَ عَبْدُ اللّٰہِ بْنُ عَبَّاسٍ وَأَبُو هُرَيْرَةَ عَنِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا فَقَالَ ابْنُ عَبَّاسٍ آخِرَ الْأَجَلَيْنِ وَقَالَ أَبُو هُرَيْرَةَ إِذَا وَلَدَتْ فَقَدْ حَلَّتْ فَدَخَلَ أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمٰنِ عَلٰى أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صَلَّي اللّٰہُ عَلَيْهِ وَسَلَّمَ فَسَأَلَهَا عَنْ ذٰلِكَ فَقَالَتْ وَلَدَتْ سُبَيْعَةُ الْأَسْلَمِيَّةُ بَعْدَ وَفَاۃِ زَوْجِهَا بِنِصْفِ شَهْرٍ فَخَطَبَهَا رَجُلَانِ أَحَدُهُمَا شَابٌّ وَالْآخَرُ كَهْلٌ فَحَطَّتْ إِلٰى الشَّابِّ فَقَالَ الْكَهْلُ لَمْ تَحِلَّ وَكَانَ أَهْلُهَا غُيَّبًا وَرَجَا إِذَا جَائَ أَهْلُهَا أَنْ يُؤْثِرُوهُ فَجَائَتْ رَسُولَ اللّٰہِ صَلَّي اللّٰہُ عَلَيْهِ وَسَلَّمَ فَقَالَ قَدْ حَلَلْتِ فَانْكِحِي مَنْ شِئْتِ۔
Abu Salamah bin Abdur Rahman narrates that Sayyiduna Abdullah bin Abbas and Sayyiduna Abu Hurairah (may Allah be pleased with them) were asked about the waiting period (‘iddah) of a woman whose husband has died and she is pregnant. Sayyiduna Ibn Abbas (may Allah be pleased with him) said: The longer of the two waiting periods will apply, while Sayyiduna Abu Hurairah (may Allah be pleased with him) said: When she gives birth to the child, her waiting period ends. Abu Salamah bin Abdur Rahman went to Sayyidah Umm Salamah (may Allah be pleased with her) and asked her about this issue. She said: When Sayyidah Subai’ah Aslamiyyah (may Allah be pleased with her) gave birth to her child half a month after her husband’s death, two men sent her marriage proposals. One of them was young and the other was somewhat older. The woman inclined towards marrying the young man. Seeing this situation, the older man said that she had not yet completed her waiting period. In fact, the woman’s family was not present there, and the older man hoped that when her family arrived, they would prefer him. Hearing his words, she went to the Prophet Muhammad (peace and blessings be upon him) and asked for a ruling. He (peace and blessings be upon him) said: Your waiting period has ended, so you may marry whomever you wish.

Brief Explanation
Benefits: … The meaning of “the longer of the two waiting periods” is that the waiting period (‘iddah) of a pregnant widow is of two types: delivery of the child (wada‘ al-haml) and four months and ten days. Now, if she gives birth before the completion of four months and ten days, then she must complete the four months and ten days. And if the pregnancy continues beyond four months and ten days, then her waiting period will be until the delivery of the child.
