Hadith 7166

عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنِ النَّبِيِّ صلى الله عليه وآله وسلم قَالَ: ((لَيْسَ عَلَى رَجُلٍ طَلَاقٌ فِيمَا لَا يَمْلِكُ وَلَا عِتَاقَ فِيمَا لَا يَمْلِكُ وَلَا بَيْعَ فِيمَا لَا يَمْلِكُ۔))
It is narrated from Sayyiduna Abdullah bin Amr bin Aas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him and his family) said: No person has the authority to divorce a woman before becoming her husband, to free a slave before owning him, or to sell something before becoming its owner.

Brief Explanation
Benefits: … If a man says that if he marries a certain woman, he will divorce her, or that she will be divorced, then divorce does not take effect by this statement, because at the time he is making this statement, he is neither the husband nor the possessor (of marriage). This is the position of Imam Shafi‘i and Imam Ahmad: that before marriage, no kind of divorce takes effect.
