Hadith 6883

عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ لَيْسَ لِلْوَلِيِّ مَعَ الثَّيِّبِ أَمْرٌ وَالْيَتِيمَةُ تُسْتَأْمَرُ فَصَمْتُهَا إِقْرَارُهَا
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said: The guardian has no authority in the matter of a widow’s marriage, and permission should be sought from a virgin girl, and her silence will be considered her consent.

Brief Explanation
Benefits: … Just as the permission of a guardian (wali) is necessary for the marriage (nikah) of a virgin girl, it is also necessary for the marriage of a widow. The meaning of the first part of this hadith is that the guardian should also take into consideration the authority and opinion of the widow, because she has already experienced married life and has become familiar with people and the environment.
