Hadith 6796

عَنْ عَلْقَمَةَ عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ رَضِيَ اللَّهُ عَنْهُ أَنَّهُ قَرَأَ سُورَةَ يُوسُفَ بِحِمْصَ فَقَالَ رَجُلٌ مَا هَكَذَا أُنْزِلَتْ فَدَنَا مِنْهُ عَبْدُ اللَّهِ فَوَجَدَ مِنْهُ رِيحَ الْخَمْرِ فَقَالَ أَتُكَذِّبُ بِالْحَقِّ وَتَشْرَبُ الرِّجْسَ لَا أَدَعُكَ حَتَّى أَجْلِدَكَ حَدًّا قَالَ فَضَرَبَهُ الْحَدَّ وَقَالَ وَاللَّهِ لَهَكَذَا أَقْرَأَنِيهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ
Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) recited Surah Yusuf in Homs. A man said: “It was not revealed in this way.” When Sayyiduna Abdullah (may Allah be pleased with him) approached him, he smelled alcohol from him. Then he said to him: “Do you deny the truth and drink this filthy thing? I will not leave you without enforcing the prescribed punishment.” Then he enforced the punishment on him and said: “By Allah! The Noble Prophet (peace and blessings be upon him) taught me this Surah in exactly this way.”

Brief Explanation
Benefits: … The drinker of alcohol will be punished in three situations:
(1) When two just witnesses give testimony.
(2) When he himself confesses.
(3) Sayyiduna Uthman radi Allahu anhu imposed the hadd (prescribed punishment) for drinking alcohol on Walid bin Uqbah on the basis that one man said: “I saw him drinking alcohol,” and another said: “I saw him vomiting alcohol.” Sayyiduna Uthman radi Allahu anhu said: “How could he vomit alcohol unless he had drunk it?” Then he imposed the hadd on him. (Sahih Muslim: 1707)

In any case, in the third situation, it is necessary for there to be a clear sign, such as vomiting, smell, etc., while being certain that this smell is coming from the stomach and is truly that of alcohol—just as from the foul odor coming from the mouth of a smoker, it becomes clearly known that he has smoked.
