عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَمْ يَقِتْ فِي الْخَمْرِ حَدًّا قَالَ ابْنُ عَبَّاسٍ شَرِبَ رَجُلٌ فَسَكِرَ فَلَقِيَ يَمِيلُ فِي فَجٍّ فَانْطُلِقَ بِهِ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ فَلَمَّا حَاذَى بِدَارِ عَبَّاسٍ انْفَلَتَ فَدَخَلَ عَلَى عَبَّاسٍ فَالْتَزَمَهُ مِنْ وَرَائِهِ فَذَكَرُوا ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَضَحِكَ وَقَالَ قَدْ فَعَلَهَا ثُمَّ لَمْ يَأْمُرْهُمْ فِيهِ بِشَيْءٍ
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) did not prescribe a fixed punishment for drinking alcohol. Sayyiduna Ibn Abbas (may Allah be pleased with them both) says that a man drank alcohol and was so intoxicated that he was staggering in a street. He was brought to the Noble Prophet (peace and blessings be upon him). When he reached near the house of Sayyiduna Abbas (may Allah be pleased with him), he slipped from their hands and entered the house of Sayyiduna Abbas (may Allah be pleased with him) and clung to him from behind. When people mentioned this to the Noble Prophet (peace and blessings be upon him), he laughed and said: Did he really do that? Then the Prophet (peace and blessings be upon him) did not give any order regarding him.
