Hadith 6794

عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِنْ سَكِرَ فَاجْلِدُوهُ ثُمَّ إِنْ سَكِرَ فَاجْلِدُوهُ فَإِنْ عَادَ فِي الرَّابِعَةِ فَاضْرِبُوا عُنُقَهُ قَالَ الزُّهْرِيُّ فَأُتِيَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِرَجُلٍ سَكْرَانَ فِي الرَّابِعَةِ فَخَلَّى سَبِيلَهُ
(Second chain) The Noble Prophet, peace and blessings be upon him, said: If someone drinks alcohol, administer the prescribed punishment to him; then if he drinks again, administer the prescribed punishment to him; if he drinks a fourth time, then behead him. Imam Zuhri says that a man was brought to the Messenger of Allah, peace and blessings be upon him, for the fourth time, and he was intoxicated, but you let him go.

Brief Explanation
Benefits: … From this hadith it is understood that the prescribed punishment (hadd) of killing the one who drinks alcohol has been abrogated. Imam Tirmidhi said: In the beginning, there was the punishment of killing, but then it was abrogated … . According to the majority of scholars, this is the accepted opinion. To our knowledge, among both the early and later scholars, there is no difference of opinion regarding the abrogation of the punishment of killing.
