بَابُ مَا جَاءَ فِي قَتْلِ الشَّارِبِ فِي الرَّابِعَةِ وَبَيَانِ نَسْخِهِChapter: What Has Been Reported Regarding Killing the Drinker on the Fourth Time and Clarifying Its Abrogation
Hadith 6788

عَنْ مُعَاوِيَةَ يَعْنِي ابْنَ أَبِي سُفْيَانَ قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَقُولُ: ((مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ، فَإِنْ عَادَ فَاجْلِدُوهُ، فَإِنْ عَادَ فَاجْلِدُوهُ، فَإِنْ عَادَ الرَّابِعَةَ فَاقْتُلُوهُ))
Narrated by Sayyiduna Muawiyah bin Abi Sufyan (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said: Whoever drinks alcohol, administer the prescribed punishment to him. If he drinks again, then administer the punishment again. If he drinks yet again, then administer the punishment again. But if he drinks alcohol a fourth time, then kill him.
