Hadith 6778

عَنْ أَنَسِ بْنِ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ قَالَ جَلَدَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِي الْخَمْرِ بِالْجَرِيدِ وَالنِّعَالِ وَجَلَدَ أَبُو بَكْرٍ قَالَ يَحْيَى فِي حَدِيثِهِ أَرْبَعِينَ فَلَمَّا كَانَ عُمَرُ وَدَنَا النَّاسُ مِنَ الرِّيفِ وَالْقُرَى قَالَ لِأَصْحَابِهِ مَا تَرَوْنَ قَالَ عَبْدُ الرَّحْمَنِ اجْعَلْهَا كَأَخَفِّ الْحُدُودِ فَجَلَدَ عُمَرُ ثَمَانِينَ
Narrated by Sayyiduna Anas bin Malik (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) prescribed the punishment for drinking wine with date palm branches and shoes. Sayyiduna Abu Bakr (may Allah be pleased with him) also prescribed the same punishment. According to Yahya’s narration, forty lashes were given. When the caliphate of Sayyiduna Umar (may Allah be pleased with him) began, people became prosperous due to the abundance of conquests, so wine drinking increased. Sayyiduna Umar (may Allah be pleased with him) consulted his companions and said: What is your opinion regarding this matter now? Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) said: You should prescribe the lightest punishment among all. Thus, Sayyiduna Umar (may Allah be pleased with him) fixed the punishment for drinking wine at eighty lashes.
