Hadith 6767

عَنْ جُنَادَةَ بْنِ أَبِي أُمَيَّةَ رَضِيَ اللَّهُ عَنْهُ أَنَّهُ قَالَ عَلَى الْمِنْبَرِ بِرُودَسَ حِينَ جَلَدَ الرَّجُلَيْنِ اللَّذَيْنِ سَرَقَا غَنَائِمَ النَّاسِ فَقَالَ إِنَّهُ لَمْ يَمْنَعْنِي مِنْ قَطْعِهِمَا إِلَّا أَنِّي سَمِعْتُ بُسْرَ بْنَ أَرْطَاةَ وَجَدَ رَجُلًا سَرَقَ فِي الْغَزْوِ يُقَالُ لَهُ مَصْدَرٌ فَجَلَدَهُ وَلَمْ يَقْطَعْ يَدَهُ وَقَالَ نَهَانَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَنِ الْقَطْعِ فِي الْغَزْوِ
Janadah bin Abi Umayyah enforced the hadd punishment on those two men on the island of Rhodes who had stolen from the spoils of war, and then ascended the pulpit and said: I did not cut off their hands because I heard from Sayyiduna Busar bin Arta’ah (may Allah be pleased with him), who found a man named Masdar in a state where he had stolen during a military expedition, so he flogged him but did not cut off his hand. He also said: The Noble Prophet (peace and blessings be upon him) has forbidden us from cutting off the hand during a military expedition.
