Hadith 6763

عَنْ أَبِي أُمَيَّةَ الْمَخْزُومِيِّ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أُتِيَ بِلِصٍّ فَاعْتَرَفَ وَلَمْ يُوجَدْ مَعَهُ مَتَاعٌ فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَا إِخَالُكَ سَرَقْتَ قَالَ بَلَى مَرَّتَيْنِ أَوْ ثَلَاثًا فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ اقْطَعُوهُ ثُمَّ جِيئُوا بِهِ قَالَ فَقَطَعُوهُ ثُمَّ جَاءُوا بِهِ فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قُلْ أَسْتَغْفِرُ اللَّهَ وَأَتُوبُ إِلَيْهِ قَالَ أَسْتَغْفِرُ اللَّهَ وَأَتُوبُ إِلَيْهِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ اللَّهُمَّ تُبْ عَلَيْهِ
It is narrated from Sayyiduna Abu Umayyah Makhzumi (may Allah be pleased with him) that a thief was brought to the Noble Prophet (peace and blessings be upon him). He confessed to the theft, but the stolen goods were not found with him. The Noble Prophet (peace and blessings be upon him) said to him: I think you have not committed the theft. He replied: Why not, I did commit the theft. This was said two or three times in the same manner. Then the Noble Prophet (peace and blessings be upon him) said: Cut off his hand and then bring him to me. The Prophet (peace and blessings be upon him) said to him: Say: أَسْتَغْفِرُ اللّٰہَ وَأَتُوْبُ إِلَیْہِ (I seek forgiveness from Allah and turn to Him in repentance). He said: أَسْتَغْفِرُ اللّٰہَ وَأَتُوْبُ إِلَیْہِ. Then the Prophet (peace and blessings be upon him) said: O Allah! Accept his repentance.

Brief Explanation
Benefits: … Whether it is necessary to obtain more than one confession in the case of theft or not, we have already clarified this issue in the explanation of Hadith number (6692). In the narrations of Bayhaqi and Daraqutni, it is stated: ((اِقْطَعُوْا ثُمَّ احْسِمُوْہُ۔)) … "Cut off his hand and then cauterize it." However, this narration is weak (see: Irwa’ al-Ghalil: 8/120).

The reason given for cauterizing is so that the bleeding may stop.

Although the prescribed punishments (hudud) are expiations, the reason for commanding repentance (tawbah) and seeking forgiveness (istighfar) at this occasion is that the criminal should firmly realize that whatever is being done to him is in recompense for his own crime. Therefore, he should express repentance and remorse. Moreover, through this act, courage will also be instilled in him, and the effects of humiliation and distress will be lessened.
