عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ رَضِيَ اللَّهُ عَنْهُ قَالَ سَرَقَ غُلَامٌ لِنُعْمَانَ الْأَنْصَارِيِّ نَخْلًا صِغَارًا فَرُفِعَ إِلَى مَرْوَانَ فَأَرَادَ أَنْ يَقْطَعَهُ فَقَالَ رَافِعُ بْنُ خَدِيجٍ رَضِيَ اللَّهُ عَنْهُ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَا يُقْطَعُ فِي الثَّمَرِ وَلَا فِي الْكَثَرِ قَالَ قُلْتُ لِيَحْيَى مَا الْكَثَرُ قَالَ الْجُمَّارُ
Muhammad bin Yahya bin Haban narrates that a slave of Sayyiduna Nu'man Ansari (may Allah be pleased with him) stole some small dates. When his case was presented in the court of Marwan, he intended to cut off the thief's hand. But Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) said that the Noble Prophet (peace and blessings be upon him) said: "The hand will not be cut off for stealing fruit and the gum of the date palm tree." I asked Yahya: What is meant by "kathar"? He said: "Jummar" (the gum of the date palm tree).
