عَنِ الْحَسَنِ بْنِ سَعْدٍ عَنْ أَبِيهِ أَنَّ يُحَنَّسَ وَصَفِيَّةَ كَانَا مِنْ سَبْيِ الْخُمُسِ فَزَنَتْ صَفِيَّةُ بِرَجُلٍ مِنَ الْخُمُسِ فَوَلَدَتْ غُلَامًا فَادَّعَاهُ الزَّانِي وَيُحَنَّسُ فَاخْتَصَمَا إِلَى عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ فَرَفَعَهُمَا إِلَى عَلِيِّ بْنِ أَبِي طَالِبٍ، فَقَالَ عَلِيٌّ: أَقْضِي فِيهِمَا بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ، الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ وَجَلَدَهُمَا خَمْسِينَ خَمْسِينَ
It is narrated from Sayyiduna Sa’d (may Allah be pleased with him) that Yuhannas and Safiyyah were among the captives of the khumus of war booty. Safiyyah committed adultery with a man from the khumus and gave birth to a child. Both the adulterer and Yuhannas claimed the child and brought their dispute to Sayyiduna Uthman (may Allah be pleased with him). He sent them to Sayyiduna Ali (may Allah be pleased with him). Sayyiduna Ali (may Allah be pleased with him) said: I will judge between them according to the decision of the Noble Prophet (peace and blessings be upon him), and that is: the child will belong to the one on whose bed he was born, and for the adulterer there will be stones. Then he gave both of them fifty lashes each.
