Hadith 6708

(وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ لِمَاعِزٍ حِينَ قَالَ زَنَيْتُ لَعَلَّكَ غَمَزْتَ أَوْ قَبَّلْتَ أَوْ نَظَرْتَ إِلَيْهَا قَالَ كَأَنَّهُ يَخَافُ أَنْ لَا يَدْرِي مَا الزِّنَا
(Second chain) When Ma'iz said that he had committed adultery, the Noble Prophet (peace and blessings be upon him) said: Perhaps you only indicated with your eyes (or it means that you only touched with your hand), or kissed, or looked? The narrator says: It seems that the Prophet (peace and blessings be upon him) feared that perhaps this person was unfamiliar with the definition of adultery.

Brief Explanation

In hadith number (6659) and the ahadith following it, various types of zina (fornication/adultery) have already been mentioned, such as the zina of the eye, hand, foot, and tongue. Therefore, it is possible that someone might consider these to be the kind of zina for which the prescribed punishment (hadd) is applied. Thus, by observing the condition of the person confessing to the crime, doubt and uncertainty can be removed in different ways.
