عَنْ عَبْدِ اللَّهِ بْنِ بُرَيْدَةَ عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُ قَالَ كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِذْ جَاءَ رَجُلٌ يُقَالُ لَهُ مَاعِزُ بْنُ مَالِكٍ فَقَالَ يَا نَبِيَّ اللَّهِ إِنِّي قَدْ زَنَيْتُ وَإِنِّي أُرِيدُ أَنْ تُطَهِّرَنِي فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ ارْجِعْ فَلَمَّا كَانَ مِنَ الْغَدِ أَتَاهُ أَيْضًا فَاعْتَرَفَ عِنْدَهُ بِالزِّنَا فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ ارْجِعْ ثُمَّ أَرْسَلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِلَى قَوْمِهِ فَسَأَلَهُمْ عَنْهُ فَقَالَ لَهُمْ مَا تَعْلَمُونَ مِنْ مَاعِزِ بْنِ مَالِكٍ الْأَسْلَمِيِّ هَلْ تَرَوْنَ بِهِ بَأْسًا أَوْ تُنْكِرُونَ مِنْ عَقْلِهِ شَيْئًا قَالُوا يَا نَبِيَّ اللَّهِ مَا نَرَى بِهِ بَأْسًا وَمَا نُنْكِرُ مِنْ عَقْلِهِ شَيْئًا ثُمَّ عَادَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ الثَّالِثَةَ فَاعْتَرَفَ عِنْدَهُ بِالزِّنَا أَيْضًا فَقَالَ يَا نَبِيَّ اللَّهِ طَهِّرْنِي فَأَرْسَلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِلَى قَوْمِهِ أَيْضًا فَسَأَلَهُمْ عَنْهُ فَقَالُوا لَهُ كَمَا قَالُوا لَهُ الْمَرَّةَ الْأُولَى مَا نَرَى بِهِ بَأْسًا وَمَا نُنْكِرُ مِنْ عَقْلِهِ شَيْئًا ثُمَّ رَجَعَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ الرَّابِعَةَ أَيْضًا فَاعْتَرَفَ عِنْدَهُ بِالزِّنَا فَأَمَرَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَحَفَرْنَا لَهُ حُفْرَةً فَجُعِلَ فِيهَا إِلَى صَدْرِهِ ثُمَّ أَمَرَ النَّاسَ أَنْ يَرْجُمُوهُ وَقَالَ بُرَيْدَةُ كُنَّا نَتَحَدَّثُ أَصْحَابَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بَيْنَنَا أَنَّ مَاعِزَ بْنَ مَالِكٍ لَوْ جَلَسَ فِي رَحْلِهِ بَعْدَ اعْتِرَافِهِ ثَلَاثَ مِرَارٍ لَمْ يَطْلُبْهُ وَإِنَّمَا رَجَمَهُ عِنْدَ الرَّابِعَةِ
It is narrated from Sayyiduna Buraidah (may Allah be pleased with him), he says: I was sitting with the Noble Prophet (peace and blessings be upon him) when a man named Ma'iz bin Malik came to the Prophet (peace and blessings be upon him) and said: O Messenger of Allah! I have committed adultery and I want you to purify me. The Noble Prophet (peace and blessings be upon him) said to him: Go back. He came again the next day and confessed to adultery before the Prophet (peace and blessings be upon him). The Noble Prophet (peace and blessings be upon him) said to him: Go back. Then the Prophet (peace and blessings be upon him) asked the people about him and said: What do you know about Ma'iz bin Malik Aslami? Do you think he is such and such, or do you have any objection to his intellect? The people said: O Messenger of Allah! We do not perceive anything wrong in him, nor do we have any objection to his intellect. Meanwhile, he came back to the Noble Prophet (peace and blessings be upon him) a third time and confessed to adultery and said: O Messenger of Allah! Purify me. The Noble Prophet (peace and blessings be upon him) again called his people and inquired about him, and they gave the same answer as before: In our opinion, there is nothing wrong with him, nor is there any defect in his intellect. Meanwhile, Ma'iz came back to the Noble Prophet (peace and blessings be upon him) a fourth time and confessed to adultery. This time, the Noble Prophet (peace and blessings be upon him) gave the order, and we dug a pit for him and buried him in it up to his chest, then the people were ordered to stone him. Sayyiduna Buraidah (may Allah be pleased with him) says: We used to talk among ourselves that if Ma'iz, after confessing to adultery three times, had sat in his house, the Prophet (peace and blessings be upon him) would not have summoned him, but when he confessed a fourth time, the Prophet (peace and blessings be upon him) ordered him to be stoned.
