Hadith 6696

عَنْ سِمَاكِ بْنِ حَرْبٍ قَالَ سَمِعْتُ جَابِرَ بْنَ سَمُرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ أُتِيَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِرَجُلٍ قَصِيرٍ أَشْعَثَ ذِي عَضَلَاتٍ عَلَيْهِ إِزَارٌ وَقَدْ زَنَى فَرَدَّهُ مَرَّتَيْنِ ثُمَّ أَمَرَ بِهِ فَرُجِمَ فَذَكَرَ نَحْوَ الْحَدِيثِ السَّابِقِ وَنَسِيَ آخِرَهُ قَالَ فَحَدَّثَنِيهِ سَعِيدُ بْنُ جُبَيْرٍ رَضِيَ اللَّهُ عَنْهُ فَقَالَ إِنَّهُ رَدَّهُ أَرْبَعَ مَرَّاتٍ
It is narrated from Sayyiduna Jabir bin Samurah (may Allah be pleased with him) that a short-statured man was brought to the Noble Prophet (peace and blessings be upon him), his condition was disheveled, he was strong and well-built, he was wearing a waistcloth, and he had committed adultery. The Prophet (peace and blessings be upon him) rejected him twice, then gave the order regarding him and he was stoned. … A narration similar to the previous narration was mentioned … Saeed bin Jubair, in his narration, transmitted these words that the Prophet (peace and blessings be upon him) rejected him four times.

Brief Explanation
Benefits: … The purpose was that he would have them confess four times, which would serve as the equivalent of four testimonies; that is why he would send them back. When this principle was fulfilled, then the command for stoning (rajm) was given. This man was none other than Sayyiduna Ma'iz, radi Allahu anhu. Under the section of benefits, it has already been clarified that making someone confess four times is not necessary; this is only as a precaution. Otherwise, the prescribed punishment (hadd) will be carried out even upon a single confession. (Abdullah Rafiq)
