Hadith 6695

وَعَنْهُ أَيْضًا قَالَ جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَاعْتَرَفَ عِنْدَهُ بِالزِّنَا قَالَ فَحَوَّلَ وَجْهَهُ قَالَ فَجَاءَ فَاعْتَرَفَ مِرَارًا فَأَمَرَ بِرَجْمِهِ فَرُجِمَ ثُمَّ أُتِيَ فَأُخْبِرَ فَقَامَ فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ مَا بَالُ رِجَالٍ كُلَّمَا نَفَرْنَا فِي سَبِيلِ اللَّهِ تَبَارَكَ وَتَعَالَى تَخَلَّفَ عِنْدَهُنَّ أَحَدُهُمْ لَهُ نَبِيبٌ كَنَبِيبِ التَّيْسِ يَمْنَحُ إِحْدَاهُنَّ الْكُثْبَةَ لَئِنْ أَمْكَنَنِي اللَّهُ عَزَّ وَجَلَّ مِنْهُمْ لَأَجْعَلَنَّهُمْ نَكَالًا
It is also narrated from Sayyiduna Jabir, may Allah be pleased with him, that Ma'iz bin Malik came to the Noble Prophet, peace and blessings be upon him, and confessed to adultery. The Prophet, peace and blessings be upon him, turned his face away, but he came from that side and again confessed to adultery, and then repeatedly confessed. So the Prophet, peace and blessings be upon him, ordered him to be stoned. Then it was reported to the Prophet, peace and blessings be upon him, that he had been stoned. So the Prophet, peace and blessings be upon him, stood up, praised and glorified Allah Almighty, and then said: What will become of those people that when we go out in the way of Allah Almighty, some man stays behind, and to fulfill the intensity of his desire, he makes a sound like a goat and, after running a little, entraps a woman? By Allah! If Allah Almighty gives me power over such a person, I will make him a lesson for the people.

Brief Explanation
Benefits: … The purpose of the Prophet’s (sallallahu alayhi wa sallam) turning away was that perhaps he (the confessor) would desist from this admission and thus be spared from the punishment. It is understood from this that a person who does not even consider the families of the mujahideen is deserving of a severe punishment. Reflect upon the fact that to kill someone by stoning them to death is a very severe punishment, yet the Noble Prophet (sallallahu alayhi wa sallam) intended to give an even harsher punishment to such a criminal.

There is no mention of giving an additional punishment. For a married person to be given one hundred lashes and then stoned (rajm) is itself a very severe punishment and serves as a lesson for the people. (Abdullah Rafiq)
