Hadith 6583

عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ خَطَبَ النَّاسَ يَوْمَ الْفَتْحِ فَقَالَ أَلَا إِنَّ دِيَةَ الْخَطَأِ الْعَمْدِ بِالسَّوْطِ أَوِ الْعَصَا مُغَلَّظَةٌ مِائَةٌ مِنْهَا أَرْبَعُونَ خَلِفَةً فِي بُطُونِهَا أَوْلَادُهَا أَلَا إِنَّ كُلَّ دَمٍ وَمَالٍ وَمَأْثُرَةٍ كَانَتْ فِي الْجَاهِلِيَّةِ تَحْتَ قَدَمَيَّ إِلَّا مَا كَانَ مِنْ سِقَايَةِ الْحَاجِّ وَسِدَانَةِ الْبَيْتِ فَإِنِّي قَدْ أَمْضَيْتُهَا لِأَهْلِهَا
Narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) delivered a sermon to the people on the day of the conquest of Makkah and said: The blood money (diyah) for accidental killing that occurs with a whip or stick, etc., is aggravated; it will be a total of one hundred camels, of which forty will be pregnant she-camels. Beware! Every blood, wealth, and pride of the Age of Ignorance is trampled under my feet. Yes, I entrust the responsibility of providing water to the pilgrims and serving the House of Allah to those who have already been performing this service.

Brief Explanation
Benefits: … In the case of killing resembling intentional murder (shibh al-‘amd), only one hundred camels are required as blood money (diyah). In this hadith, the specification of forty has been clarified—that they should be pregnant she-camels. The details of the remaining sixty camels are mentioned in hadith number (6580). According to these two ahadith, the total diyah amounts to one hundred (100) camels: thirty hiqqah, thirty jadha‘ah, and forty pregnant she-camels. In this type of killing, there is no retribution (qisas); however, the diyah is as heavy as the diyah for intentional murder (qatl ‘amd).
