Hadith 6556

عَنْ حَمْلِ بْنِ النَّابِغَةِ رَضِيَ اللَّهُ عَنْهُ قَالَ كُنْتُ بَيْنَ بَيْتَيْ امْرَأَتَيَّ فَضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِمِسْطَحٍ فَقَتَلَتْهَا وَجَنِينَهَا فَقَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِي جَنِينِهَا بِغُرَّةٍ وَأَنْ تُقْتَلَ بِهَا
It is narrated from Sayyiduna Haml bin Nabighah (may Allah be pleased with him), he says: I was between the houses of my two wives, one of them struck the other with a stick, as a result of which that woman died and her unborn child was also lost. The Noble Prophet (peace and blessings be upon him) decided that for the unborn child, a slave man or woman would be given, and the woman (who struck) would be killed in retribution.

Brief Explanation
Benefits: … Two rulings are established explicitly from these ahadith: (1) The non-Muslim killer of a woman will be killed in retribution (qisas), and (2) a woman who kills a woman will also be killed in retribution (qisas).

As for the issue of whether, when a Muslim man kills a Muslim woman, retribution (qisas) will be taken from him or not, then according to the majority of the scholars, retribution (qisas) will be taken from the man for the woman. The evidence for this view is hadith number (6549), in which the Prophet sallallahu alayhi wa sallam declared the blood of all the people of Islam to be equal.

Imam Ibn al-Mundhir rahimahullah said: Apart from the narration transmitted from Sayyiduna Ali radi Allahu anhu, Imam Hasan al-Basri, and Imam Ata, there is consensus (ijma‘) on killing a man in retribution (qisas) for a woman. (Al-Ijma‘ by Ibn al-Mundhir: p. 144, no. 653)
