Hadith 6550

عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَضَى أَنْ لَا يُقْتَلَ مُسْلِمٌ بِكَافِرٍ زَادَ فِي رِوَايَةٍ وَدِيَةُ الْكَافِرِ نِصْفُ دِيَةِ الْمُسْلِمِ
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) decreed that a Muslim will not be killed in retaliation for a disbeliever. In another narration: The blood money for a disbeliever is equal to half the blood money for a Muslim.

Brief Explanation
Benefits: … The status of a Muslim and a disbeliever can never be equal, but Islam also does not approve of excess. Therefore, if a Muslim kills a disbeliever, then half the blood money (diyah) must be given to the heirs of the disbeliever.
