عَنْ أَبِي عِمْرَانَ الْجَوْنِيِّ رَضِيَ اللَّهُ عَنْهُ قَالَ حَدَّثَنِي بَعْضُ أَصْحَابِ مُحَمَّدٍ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَغَزَوْنَا نَحْوَ فَارِسَ فَقَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَنْ بَاتَ فَوْقَ بَيْتٍ لَيْسَ لَهُ إِجَّارٌ فَوَقَعَ فَمَاتَ فَقَدْ بَرِئَتْ مِنْهُ الذِّمَّةُ وَمَنْ رَكِبَ الْبَحْرَ عِنْدَ ارْتِجَاجِهِ فَمَاتَ فَقَدْ بَرِئَتْ مِنْهُ الذِّمَّةُ
A companion of the Messenger narrates that we were on an expedition towards Persia, during which the Messenger of Allah, peace and blessings be upon him, said: Whoever sleeps on the roof of a house that has no covering (or barrier), and if he falls and dies, then there will be no liability for him. Similarly, whoever undertakes a sea journey while the sea is turbulent, and he (drowns and) dies, then there will also be no liability for him.
