بَابُ الْقَضَاءِ بِالْقُرْعَةِ فِيمَا إِذَا إِذْهَا الْخَصْمَانِ مِلْكَ شَيْءٍ وَلَمْ يَكُن لَهُمَا بَينَةٌ وَمَا ذَا يَفْعَلُ إِذَا كَانَ لَهُمَا بينةٌ وَتَعَارَضَتِ البَيِّنَاتُChapter: Judging by drawing lots when two litigants claim ownership and have no evidence, and what to do if both have evidence and the evidences conflict
Hadith 6422

عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَجُلَيْنِ تَدَارَآ فِي دَابَّةٍ لَيْسَ لِوَاحِدٍ مِنْهُمَا بَيِّنَةٌ فَأَمَرَهُمَا نَبِيُّ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنْ يَسْتَهِمَا عَلَى الْيَمِينِ أَحَبَّا أَوْ كَرِهَا
It is narrated from Sayyiduna Abu Hurairah, may Allah be pleased with him, that two men disputed over an animal, while neither of them had any proof. So the Noble Prophet, peace and blessings be upon him, ordered them to draw lots for taking an oath, whether they liked this ruling or not.
