Hadith 6418

عَنِ ابْنِ عَبَّاسٍ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَضَى بِيَمِينٍ وَشَاهِدٍ، قَالَ زَيْدُ بْنُ الْحُبَابِ: سَأَلْتُ مَالِكَ بْنَ أَنَسٍ عَنِ الْيَمِينِ وَالشَّاهِدِ هَلْ يَجُوزُ فِي الطَّلَاقِ وَالْعِتَاقِ، فَقَالَ: لَا، إِنَّمَا هَذَا فِي الشَّرَائِ وَالْبَيْعِ وَأَشْبَاهِهِ
It is narrated from Sayyiduna Ibn Abbas, may Allah be pleased with them both, that the Noble Prophet, peace and blessings be upon him, gave a verdict based on one witness and an oath. Zaid bin Hubab says: I asked Sayyiduna Malik bin Anas about the oath and witness, whether it is sufficient in cases of divorce and the emancipation of a slave as well? He said: No, this is only for transactions such as buying and selling.
