It is narrated from Ibn Abi Mulaykah, he says: Sayyiduna Ibn Abbas (may Allah be pleased with them both) sent me this writing that the Messenger of Allah (peace and blessings be upon him) said: If people were given according to their claims, they would claim the lives and wealth of others, but the oath will be upon the one against whom the claim is made.

Brief Explanation
Benefits: … This is a very important and simple law of Islamic Shari'ah that the claimant must present witnesses for his claim; otherwise, the defendant will be acquitted of the claim by taking an oath. However, he must completely abstain from taking a false oath, otherwise he will become subject to the next hadith. In such a situation, the judge should admonish and advise, and explain the importance of the Hereafter and the transience of this world.
