Hadith 6368

عَنِ الْمِقْدَامِ بْنِ مَعْدِيكَرِبَ الْكِنْدِيِّ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنَّهُ قَالَ: ((مَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ، وَمَنْ تَرَكَ دَيْنًا أَوْ ضَيَاعَةً فَإِلَيَّ، وَأَنَا وَلِيُّ مَنْ لَا وَلِيَّ لَهُ، أَفُكُّ عَنْهُ وَأَرِثُ مَالَهُ، وَالْخَالُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ، يَفُكُّ عَنْهُ وَيَرِثُ مَالَهُ)) وَفِي لَفْظٍ: ((وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ، وَأَنَا وَارِثُ مَنْ لَا وَارِثَ لَهُ، أَرِثُهُ وَأَعْقِلُ عَنْهُ))
Narrated from Sayyiduna Miqdam bin Ma’di Karib al-Kindi (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: Whoever leaves behind wealth in inheritance, it will belong to his heirs, and whoever leaves behind debt or small children, then I am responsible for him. Whoever has no guardian, I am his guardian; I will pay on his behalf and I will be his heir. And whoever has no heir, his maternal uncle will be his heir and he will pay on his behalf and be his heir. In another narration: The maternal uncle will be the heir of the one who has no heir, and whoever has absolutely no heir, I will be his heir and I will pay the blood money on his behalf.

Brief Explanation
Benefits: … “I will pay on his behalf.” This means that the payments which were due upon the deceased because of some of his offenses, and which the ‘asaba (agnatic heirs) would normally have to pay, will be paid by the Prophet sallallahu alayhi wa sallam.

Benefits: … Dhawu al-arham are those relatives who are neither among the ashab al-furud (those entitled to fixed shares) nor among the ‘asaba (agnatic heirs), for example: maternal uncle, maternal aunt, paternal aunt, granddaughter, etc. When among the relatives of the deceased there is no one from the ashab al-furud, nor from the nasabi ‘asaba (agnatic heirs by lineage), nor from the sababi ‘asaba (agnatic heirs by cause), then his estate will be distributed among the dhaw al-arham. There is great difference of opinion regarding the manner of their inheritance; consult a book related to this field for further study.

In this blessed hadith, it is clarified that when the deceased has no heir present, his estate will be given to the maternal uncle, while the maternal uncle is among the dhaw al-arham.
