Hadith 6362

عَنْ عِمْرَانَ بْنِ حُصَيْنٍ أَنَّ رَجُلًا أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ: إِنَّ ابْنَ ابْنِي مَاتَ، فَمَا لِي مِنْ مِيرَاثِهِ؟ قَالَ: ((لَكَ السُّدُسُ)) قَالَ: ((فَلَمَّا أَدْبَرَ دَعَاهُ)) قَالَ: ((لَكَ سُدُسٌ آخَرُ)) فَلَمَّا أَدْبَرَ دَعَاهُ قَالَ: ((إِنَّ السُّدُسَ الْآخَرَ طُعْمَةٌ))
Narrated by Sayyiduna Imran bin Husain (may Allah be pleased with him): A man came to the service of the Noble Prophet (peace and blessings be upon him) and said: My grandson has passed away, what will I receive from his inheritance? The Prophet (peace and blessings be upon him) said: For you is one-sixth. When he turned to leave, the Prophet (peace and blessings be upon him) called him back and said: You will also get one-sixth. Then when he was about to leave, the Prophet (peace and blessings be upon him) called him back and said: This one-sixth is extra for you, (it is not given as a share).

Brief Explanation
Benefits: … In the Arabic language, both paternal and maternal grandfathers are called "jadd." In the science of inheritance, "jadd" is of two types: (1) Jadd Sahih (true grandfather) and (2) Jadd Fasid (defective grandfather). Only the former, that is, the Jadd Sahih, can be an heir.

Jadd Sahih: … That grandfather in whose lineage to the deceased, no woman intervenes. For example: paternal grandfather, great-grandfather (father's father's father).

Jadd Fasid: … That grandfather in whose lineage to the deceased, a woman intervenes. For example: maternal grandfather, father of the paternal grandmother.

The father and the Jadd Sahih are both among the Ashab al-Furud (those entitled to fixed shares) and also 'Asabah (residuaries). They first take their prescribed share, and after that, a portion of the estate may also be given to them as 'Asabah.

The situation of the issue is that the questioner's grandson has passed away and has left behind two daughters. For these two daughters, the share is two-thirds (2/3), and for the (questioner) grandfather, the share is one-sixth (1/6). Since there is no other 'Asabah, the grandfather (the questioner) stands in the place of the father and also becomes the 'Asabah, and he will also receive the remaining (1/6). Regarding this subsequent sixth share, the Noble Prophet sallallahu alayhi wa sallam said that this is extra, meaning it is given as 'Asabah in addition to the fixed and prescribed share.
