حَدَّثَنَا عَبْدُ الرَّزَّاقِ وَمُحَمَّدُ بْنُ بَكْرٍ قَالَا أَنْبَأَنَا جُرَيْجٌ أَخْبَرَنِي ابْنُ شِهَابٍ الزُّهْرِيُّ عَنْ حَدِيثِ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ الْأَنْصَارِيِّ رَضِيَ اللَّهُ عَنْهُمَا أَخْبَرَنِي أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَضَى أَيُّمَا رَجُلٍ أَعْمَرَ رَجُلًا عُمْرَى لَهُ وَلِعَقِبِهِ فَقَالَ قَدْ أَعْطَيْتُكَهَا وَعَقِبَكَ مَا بَقِيَ مِنْكُمْ أَحَدٌ فَإِنَّمَا هِيَ قَالَ ابْنُ بَكْرٍ لِمَنْ أُعْطَاهَا وَقَالَ عَبْدُ الرَّزَّاقِ لِمَنْ أُعْطِيَهَا وَأَنَّهَا لَا تَرْجِعُ إِلَى صَاحِبِهَا مِنْ أَجْلِ أَنَّهُ أَعْطَاهَا عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ
Sayyiduna Jabir bin Abdullah Ansari (may Allah be pleased with them both) narrates that the Messenger of Allah (peace and blessings be upon him and his family) gave a ruling regarding ‘Umra, saying: If a person gives something as ‘Umra to another person and his descendants, saying: “I have given this thing to you and your descendants, as long as any of you remain,” then this thing will belong to the one to whom it was given, and it will not return to the original owner, because he has given such a gift in which the laws of inheritance have already come into effect.
