عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أَعْطَى أُمَّهُ حَدِيقَةً مِنْ نَخْلٍ حَيَاتَهَا فَمَاتَتْ فَجَاءَ إِخْوَتُهُ فَقَالُوا نَحْنُ فِيهِ شَرْعٌ سَوَاءٌ فَأَبَى فَاخْتَصَمُوا إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَسَمَهَا بَيْنَهُمْ مِيرَاثًا
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that an Ansari gave a date orchard to his mother for her lifetime. When his mother passed away, the other brothers of this Ansari came and said, "We are all equal partners in this orchard." But he refused. So they brought the dispute to the Noble Prophet (peace and blessings be upon him). The Prophet (peace and blessings be upon him) divided the orchard among them as inheritance.
