Hadith 6306

عَنْ زَيْدِ بْنِ ثَابِتٍ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَنْ أَعْمَرَ عُمْرَى فَهِيَ لِمُعْمَرِهِ مَحْيَاهُ وَمَمَاتَهُ لَا تُرْقِبُوا فَمَنْ أَرْقَبَ شَيْئًا فَهُوَ سَبِيلُ الْمِيرَاثِ
It is narrated from Sayyiduna Zaid bin Thabit (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: Whoever gives something to someone as 'Umra, then in life and death it will belong to the one to whom it was given. Do not give anything as Ruqba; whoever gives something as Ruqba, it will enter into the routine of inheritance.

Brief Explanation
Benefits: … From these narrations, the intent of the Prophet sallallahu alayhi wa sallam is that it should not happen that you give things as ‘umra or ruqba gifts in the hope that they will eventually return to you, whereas in reality, they will become permanently owned by the one to whom they are given. Therefore, whoever wishes to give something as ruqba or ‘umra should know that this thing will not return, so he should be cautious. And if, after knowing the rulings of ‘umra and ruqba, someone still wishes to give something in this manner, then he may certainly do so.
