عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا قَالَ نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَنِ الرُّقْبَى وَقَالَ مَنْ أُرْقِبَ فَهُوَ لَهُ
Narrated by Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) forbade Raqba and said: Whatever is given to someone as Raqba will belong to him.
Brief Explanation
Benefits: … This prohibition is not for the sake of declaring something unlawful (haram), but rather for instruction and guidance. That is, the Messenger of Allah (sallallahu alayhi wa sallam) intends to convey that there is no benefit in giving your house or wealth as a gift of ruqba. However, if you do wish to give in this manner, then know that whatever is given as ruqba will not return to you, and it will permanently leave your ownership.
