Hadith 6230

عَنْ عَمْرِو بْنِ الشَّرِيدِ عَنْ أَبِيهِ الشَّرِيدِ بْنِ سُوَيْدٍ رَضِيَ اللَّهُ عَنْهُ قَالَ قُلْتُ يَا رَسُولَ اللَّهِ أَرْضٌ لَيْسَ لِأَحَدٍ فِيهَا شِرْكٌ وَلَا قَسْمٌ إِلَّا الْجِوَارَ قَالَ الْجَارُ أَحَقُّ بِسَقَبِهِ مَا كَانَ
It is narrated from Sayyiduna Abu Rafi’ (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him and his family) said: The neighbor, due to his closeness, has more right to purchase a thing.
Brief Explanation
Benefits: … From the ahadith of this chapter, it is established that in every jointly owned thing, the partner has the right to exercise pre-emption (shuf‘ah). In the aforementioned ahadith, it is also mentioned that the neighbor has the right to exercise pre-emption (shuf‘ah) as well. The clarification of this matter will be given in the next chapter, insha’Allah.
