Hadith 6223

عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ الشُّفْعَةُ فِي كُلِّ شِرْكٍ رَبْعَةٍ أَوْ حَائِطٍ لَا يَصْلُحُ لَهُ أَنْ يَبِيعَ حَتَّى يُؤْذِنَ شَرِيكَهُ فَإِنْ بَاعَ فَهُوَ أَحَقُّ بِهِ حَتَّى يُؤْذِنَهُ
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: There is pre-emption (shuf‘a) in every jointly owned thing, whether it is a house or a garden. It is not permissible for one partner to sell such a thing until he informs his partner about it. If he sells it without informing his partner, then the partner has more right to it, until he is informed.
