Hadith 6217

عَنْ قَابُوسَ بْنِ الْمُخَارِقِ عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُ قَالَ أَتَى رَجُلٌ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ إِنْ أَتَانِي رَجُلٌ يَأْخُذُ مَالِي قَالَ تُذَكِّرُهُ بِاللَّهِ تَعَالَى قَالَ أَرَأَيْتَ إِنْ ذَكَّرْتُهُ بِاللَّهِ فَلَمْ يَنْتَهِ قَالَ تَسْتَعِينُ عَلَيْهِ بِالسُّلْطَانِ قَالَ أَرَأَيْتَ إِنْ كَانَ السُّلْطَانُ مِنِّي نَائِيًا قَالَ تَسْتَعِينُ عَلَيْهِ بِالْمُسْلِمِينَ قَالَ أَرَأَيْتَ إِنْ لَمْ يَحْضُرْنِي أَحَدٌ مِنَ الْمُسْلِمِينَ وَعَجِلَ عَلَيَّ قَالَ فَقَاتِلْ حَتَّى تَحُوزَ مَالَكَ أَوْ تُقْتَلَ فَتَكُونَ فِي شُهَدَاءِ الْآخِرَةِ
It is narrated from Sayyiduna Makharik (may Allah be pleased with him) that a man came to the Noble Prophet (peace and blessings be upon him) and said: "A man comes to me and wants to take my wealth." The Prophet (peace and blessings be upon him) said: "Make him swear by Allah." He said: "If I make him swear by Allah but he does not desist?" The Prophet (peace and blessings be upon him) said: "Seek help against him from the ruler." He said: "If the ruler is far away (and access to him is not possible)?" The Prophet (peace and blessings be upon him) said: "Seek help against him from other Muslims." He said: "If there are no Muslims there either?" The Prophet (peace and blessings be upon him) said: "Then fight him, until you protect your wealth or become among the martyrs of the Hereafter."

Brief Explanation
Benefits: … In these hadiths, very important matters have been stated: that if a person seeks to seize someone’s wealth or intends to kill him, then he should be pleaded with for the sake of Allah Ta’ala and given admonition and advice. It is possible that this may have an effect on him and he may desist from his evil intention. If this method proves ineffective, then the ruler should be informed by some means. Otherwise, the general Muslims should be called upon for help. If none of these three methods prove effective, then one should defend oneself through fighting. If the oppressed person is killed, then he will be considered a martyr (shahid) in ruling, that is, in the Hereafter he will be regarded as a martyr. However, in this world, he will be given a ritual bath (ghusl) like an ordinary deceased person, shrouded, and the funeral prayer (salat al-janazah) will be performed for him.
