بَابُ مَنْ زَرَعَ فِي أَرْضِ قَوْمٍ بِغَيْرِ إِذْنِهِمْ وَمَنْ أَخَذَ شَيْئًا مِنَ الثَّمَرِ أَوِ الزَّرْعِ بِغَيْرِ إِذْنِ أَهْلِهِChapter: One who plants in someone’s land without their permission, or takes some fruit or crop without the owner’s permission
Hadith 6209

عَنْ عُبَادَةَ بْنِ الصَّامِتِ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَضَى أَنَّهُ لَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ
It is narrated from Sayyiduna ‘Ubādah bin Sāmit (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) decreed that the oppressor has no right to the root.
Brief Explanation
Benefits: … Its explanation is as follows: if a person cultivates land that is not owned by anyone, it becomes his property. Now, if another person comes and plants a tree in that land in order to take possession of it, then the Prophet sallallahu alayhi wa sallam states that this person is an oppressor and a root of injustice, and he has no right whatsoever.
