بَابُ مَنْ زَرَعَ فِي أَرْضِ قَوْمٍ بِغَيْرِ إِذْنِهِمْ وَمَنْ أَخَذَ شَيْئًا مِنَ الثَّمَرِ أَوِ الزَّرْعِ بِغَيْرِ إِذْنِ أَهْلِهِChapter: One who plants in someone’s land without their permission, or takes some fruit or crop without the owner’s permission

عَنْ رَافِعِ بْنِ خَدِيجٍ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَنْ زَرَعَ فِي أَرْضِ قَوْمٍ بِغَيْرِ إِذْنِهِمْ فَلَيْسَ لَهُ مِنَ الزَّرْعِ شَيْءٌ وَتُرَدُّ عَلَيْهِ نَفَقَتُهُ
It is narrated from Sayyiduna Rafi‘ bin Khadij (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: Whoever cultivates someone’s land without his permission, he will not receive anything from the produce of the crop, but his expenses will be returned to him.
Brief Explanation
Benefits: … Reflect on the justice and fairness of Islam: if a person, while committing injustice, cultivates a crop on someone else’s land, then the expenses of cultivation will be returned to him, so that he is not wronged in return for his wrongdoing. This is Islam’s treatment even with the oppressor; as for the oppressed, you can estimate for yourself.
