Hadith 6206

عَنْ سَمُرَةَ بْنِ جُنْدُبٍ رَضِيَ اللَّهُ عَنْهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ عَلَى الْيَدِ مَا أَخَذَتْ حَتَّى تُؤَدِّيَهُ ثُمَّ نَسِيَ الْحَسَنُ قَالَ لَا يَضْمَنُ
Narrated by Sayyiduna Samurah bin Jundub (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: Whatever the hand takes, it remains a responsibility upon him until he pays it back. Then Hasan Basri forgot and said: He is not liable.

Brief Explanation
Benefits: … The meaning of this hadith is that whoever takes someone’s property as a loan for use (‘ariyah), as a trust (amanah), or by usurpation (ghasb), he will have to return it. This subject is also established by other ahadith. Hasan al-Basri, due to forgetting the hadith he narrated, used to say that the one who takes something as ‘ariyah is not liable, but the hadith he narrated does not support this opinion of his.
