عَنْ كَثِيرِ بْنِ عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ عَوْفٍ الْمُزَنِيِّ عَنْ أَبِيهِ عَنْ جَدِّهِ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَقْطَعَ بِلَالَ بْنَ الْحَارِثِ مَعَادِنَ الْقَبَلِيَّةِ جَلْسِيَّهَا وَغَوْرِيَّهَا وَحَيْثُ يَصْلُحُ لِلزَّرْعِ مِنْ قُدْسٍ وَلَمْ يُعْطِهِ حَقَّ مُسْلِمٍ وَكَتَبَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ هَذَا مَا أَعْطَى مُحَمَّدٌ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِلَالَ بْنَ الْحَارِثِ الْمُزَنِيَّ أَعْطَاهُ مَعَادِنَ الْقَبَلِيَّةِ جَلْسِيَّهَا وَغَوْرِيَّهَا وَحَيْثُ يَصْلُحُ لِلزَّرْعِ مِنْ قُدْسٍ وَلَمْ يُعْطِهِ حَقَّ مُسْلِمٍ
'Amr bin 'Awf narrates from his father, and he from his grandfather, that the Messenger of Allah, peace and blessings be upon him, granted Sayyiduna Bilal bin Harith, may Allah be pleased with him, the mines of the Qabliyyah area as a fief. He gave him all the high and low land of that place and whatever was cultivable in the Quds mountain, all of it was given to him, while the Prophet, peace and blessings be upon him, did not give him the right of any Muslim. The Prophet, peace and blessings be upon him, wrote this document in his favor: In the name of Allah, the Most Gracious, the Most Merciful. This is the land which Muhammad, the Messenger of Allah, peace and blessings be upon him, has given to Bilal bin Harith Muzani. He, peace and blessings be upon him, has given him the mines of the Qabliyyah area, all the high and low land of that place, and whatever is cultivable in the Quds mountain, he has given to him, while this was not the right of any Muslim that was given to him.
Brief Explanation
Benefits: … This land was also not owned by anyone; the ruler of the time can allot such a valuable thing to someone. However, here another narration is also worthy of attention: It is narrated from Sayyiduna Abyad bin Hamaal radi Allahu anhu that upon his request, the Noble Prophet sallallahu alayhi wa sallam granted him a salt mine. Seeing this, one of those present said: "You have granted this person a perpetual benefit." Upon hearing this, the Prophet sallallahu alayhi wa sallam took back the mine from him. (Abu Dawood: 3064, Tirmidhi: 1380)
According to the hadith of this chapter, the Prophet sallallahu alayhi wa sallam allotted the mine, but the hadith of Sayyiduna Abyad radi Allahu anhu proves that something like a mine should not be allotted to a specific individual. The way to reconcile and harmonize these two hadiths is that there are two types of mines: (1) Internal mines: These are mines whose extraction requires effort and labor, such as iron and copper, etc. (2) Surface mines: These are mines whose extraction does not require effort, such as salt, oil, and antimony (surma), etc. The ruler can allot internal mines to someone, as the Prophet sallallahu alayhi wa sallam gave to Sayyiduna Bilal bin Harith radi Allahu anhu, but surface mines should not be granted to anyone, so that all people can benefit equally and no one faces hardship. This is the meaning of the hadith of Sayyiduna Abyad radi Allahu anhu.
